<br />City Council Regular Meeting -10/09/06 <br />Minutes - Page 15 <br /> <br />neighborhood character, and potential for future variances, were <br />not applicable as findings with legal standing. <br /> <br />City Attorney Anderson opined that, while some findings may be <br />found legally insufficient in a court of law, that would not affect <br />the validity of all of the findings; and the City Council would be <br />sending a message to property owners for future reference. <br /> <br />The motion as stated for denial, based on outlined findings, was <br />accepted as stated with unanimous Council support of the motion. <br />Staff was directed to provide the findings in writing to the <br />applicant as part 0 the 60-day review process. <br /> <br />6. <br /> <br />Conduct a Public Hearing to Acknowledge the Expenditure of <br />Tax-exempt Funds by the Evangelical Lutheran Good <br />Samaritan Society <br />Interim City Manager Chris Miller reviewed the request of the <br />Evangelical Lutheran Good Samaritan Society, under federal and <br />state statutes, for the City to pledge bond issuance authority for <br />the benefit of a healthcare facility. At the request of Mayor <br />Klausing, Mr. Miller reviewed the process and the host city's <br />support, clarifying that there was no risk or obligation to the City <br />for this bond issuance. <br /> <br />Mayor Klausing opened and closed the Public Hearing at 7:49 <br />p.m., with no one appearing for or against. <br /> <br />Maschka moved, Kough seconded, adoption of Resolution No. <br />10439 entitled, "Resolution Approving the Issuance of Bonds by <br />the Colorado Health Facilities Authority to Refinance a Project of <br />the Evangelical Lutheran Good Samaritan Society, a North <br />Dakota Nonprofit Corporation, Previously Financed Under the <br />Minnesota Agricultural and Economic Development Board Act." <br /> <br />Roll Call <br />Ayes: Kough, Maschka; Ihlan; Pust and Klausing. <br />Nays: None. <br /> <br />7. <br /> <br />Continue Consideration of the Appeal ofthe Variance Board's <br />Action to Deny the Request by Charles Weleczki & Todd Iliff <br />for a Variance to ~ 1004.016 (PF 3781) <br /> <br />Resolution 10439 <br />Public Hearing <br />Acknowledge the <br />Expenditure of <br />Tax-exempt Funds <br />by the Evangelical <br />Lutheran Good <br />Samaritan Society <br /> <br />Resolution 10440 <br />Continue <br />Consideration of <br />
