Dear Mayor and City Council Members,

I wish to express my concerns with the appeal of the Variance Board's action to Deny the Request by Charles
Weleczkl and Todd Iliff for a Variance to 9 1004.016. (PF3781).

First of all, my name Is Tim Garvin and I reside at 1812 Dale Ct which is 4 lots SW of the above mentioned parcel
that is being discussed at tonight's meeting. I'm unable to attend. I apologize In advance for taking your
time through a letter.

I am not against developing and I know at some point there will be something built on this odd shape lot created
by Mr. and Mrs. Weleczki when they sub-divided this lot and their old residence.

Below are a list of concerns I have with regards to approving the request at this point and time.

The biggest Issue I have Is allowing for a blank format or bypassing of the entire Dale Ct set back for the parcel.
It seems like we are putting the cart before the horse. I don't think it would be In the City's best Interest to set
this precedence. I'd further like to think it would be in everyone's Interest to see specific plans and approve a
dwelling appropriate for the neighborhood, the busy corner and the site lines.

Another major issue I have is they are asking for a variance and passing it off as if it were no fault of their own
that the lot Is odd size and can not accommodate a standard size home of today. This Is far from the truth since
they sub-divided It and created this odd lot themselves. I believe the planning commission granted the request
because Mr. Weleczki and Mr. Iliff had either provided documents or stated that they had an architect draw up
plans with a tuck-under garage meeting the set backs. My understanding from the variance meeting I attended
was the planning commission reluctantly approved this, but stated don't expect any variances granted in the
future.
