<br />1) Existing uses, whether confonning to the B-6 district requirements as <br />pennitted uses, PU'Ds, or non-conforming uses, lnay renlain in their current <br />locations and configuration as long as they wish to operate there. However, <br />expansion and/or intensification of pre-existing non-confonning uses will not <br />be penllitted. (See City Attorney Janmik's description of non-confomling <br />uses, dated 06/05/02. Also see the B-6 Zoning District Ordinance of 12/17/01 <br />for permitted uses.) <br /> <br />2) Confonning uses that wish to expand will be evaluated on a case by case basis <br />as to whether the expansion will nleet the size, area, and improvelnent <br />requirements of the EnvironnlentallInpact Statelnent done for the Twin Lakes <br />Master Plan as well as those of the B-6 zone at the tinle they apply for a <br />building pernlit, or at such earlier time as the property owner requests such a <br />detennination. In general, a pre-existing use expanding in an existing building <br />is pernlitted. A nlix of existing uses, sonle permitted some not permitted, <br />being renovated or expanded within the walls of the existing building, and <br />l1lceting the environlnental, life/safety, and building code requirenlents, will <br />be allowed. <br /> <br />3) Truck traffic should be minil11ized as much as possible and still serve the <br />needs of the businesses in the Business Park. Distribution companies and <br />truck ternlinals with fleets of trucks are encouraged to locate west of 1-35W in <br />the remaining industrial areas. <br /> <br />4) By design and managenlent, traffic should have incentives created by the road <br />system to use the Parkway and Interstate; County Road C, and Snelling <br />Avenue as 111uch as possible. Traffic should be discouraged froln using <br />Fairview Avenue and cutting through the adjoining residential areas. <br /> <br />5) Noise in a business park must meet the MnPCA Noise Standards and should <br />be conlpatible with office, research, laboratory, and residential uses which <br />may be next door. Industrial and manufacturing noises such as air horns, high <br />pitched or pressure releasing exhausts, whistles, and engine whines, dust bag <br />banging, metal stamping are acceptable in industrial districts, but new uses <br />with such sound emissions would not be permitted in a B-6 business park <br />district. <br /> <br />6) Air quality is another concern. New industrial equipment in a pre-existing use <br />will be considered intensification if it emits more untreated exhausts or nlay <br />create nuisance or sickening situations either on the site or in nearby sites. <br /> <br />7) Surface water is also a concern. New untreated runoff from buildings or roofs, <br />without on-site cOlTesponding holding basins, will be considered <br />intensification. <br /> <br />2 <br />
