<br />City Council Minutes - 07/29/02 <br />Page 12 <br /> <br />Properties for Property Located at 1900 Oakcrest <br />Avenue (PF 3411 )," providing for a vehicle rental and <br />leasing business with related sales of motor vehicles as <br />limited by Section 10007.02D12 of the Roseville City <br />Code, based on the findings of Section 4 and the <br />conditions of Section 5 of the project report dated July <br />29, 2002. <br /> <br />Mr. Peter Downs, President, and Mr. Blake Alberts, <br />Secretary/Treasurer, of Synergy Motor Car Company, <br />were present, and provided a history of their request. <br /> <br />When the applicant had applied for the Conditional Use <br />Permit, it was their understanding that it would include <br />provisions for resale of non-leased vehicles that were <br />purchased directly from other sources. Upon receipt <br />today of a response from Planning Consultant, Thomas <br />Paschke, that this use was not permitted under existing <br />City code. The applicant was looking to the City <br />Council for approval of their Permit and clarification of <br />code. <br /> <br />City Attorney Jamnik verified that existing code would <br />specifically exclude used car sales separate and distinct <br />other than those cars previously leased out by the <br />company. <br /> <br />Mayor Kysylyczyn asked ifit was the applicant's intent <br />to bring in cars from other sources. The applicant <br />responded in the affirmative. <br /> <br />Councilmember Maschka noted that the applicant's letter <br />dated June 7, 2002, clearly stated their intent. <br /> <br />Mr. Welsch stated that, upon his first meeting with the <br />applicant, the specific applicable portion of the code was <br />pointed out, and that was communicated to the City <br />Planner, with no interpretation that this use was to be <br />considered a used car dealership. <br /> <br />Councilmember Kough questioned if any objections <br />
