4.0B <br />ACKGROUND <br />12 <br />The property at 1770 Chatsworth Street, located in City Planning District 15, has a <br />13 <br />Comprehensive Plan designation of Low Density Residential (LDR) and a zoning <br />14 <br />classification of Low Density Residential-1 (LDR-1) District. <br />15 <br />5.0VA <br />ACATIONNALYSIS <br />16 <br />5.1Public Works Department staff has reviewed the proposed vacation of the sewer <br />17 <br />easement as illustrated in Attachment C. In light of the fact that sewer infrastructure was <br />18 <br />never built, nor are there any plans to install sewer in that location, Public Works staff <br />19 <br />finds that vacating the southern 5 feet of the easement on the subject property would not <br />20 <br />harm the public health, safety and general welfare of the community. Public Works staff <br />21 <br />recommends retaining the northern 5 feet of the easement similar to the drainage and <br />22 <br />utility easement required along the side property lines of newly created residential <br />23 <br />parcels. <br />24 <br />5.2Since the Planning Commission is responsible for holding the public hearings for <br />25 <br />applications like the proposed vacation, Planning Division staff is preparing the report <br />26 <br />and supporting materials for review. But Planning staff doesn’t have an interest, per se, <br />27 <br />in such proposals and merely conveys the comments and recommendation of the Public <br />28 <br />Works Department in addition to coordinating the review of the proposal by the Planning <br />29 <br />Commission and City Council. <br />30 <br />6.0PC <br />UBLICOMMENT <br />31 <br />The duly-noticed public hearing for this application was held by the Planning <br />32 <br />Commission on May 2, 2012; no members of the public were present to comment on the <br />33 <br />proposal. After closing the public hearing, the Planning Commission voted (7-0) to <br />34 <br />approve the requested ; draft minutes of the public hearing are <br />EASEMENTVACATION <br />35 <br />included with this report as Attachment D.
