Attachment E <br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br />1 <br />st <br />of Roseville, County of Ramsey, Minnesota, was held on the 21 day of May 2012 at 6:00 p.m. <br />2 <br />The following Members were present: ___________; <br />3 <br />and ________ were absent. <br />4 <br />Council Member _____ introduced the following resolution and moved its adoption: <br />5 <br />RESOLUTION NO. ____ <br />6 <br />A RESOLUTION APPROVING THE VACATION OF A PORTION OF THE SEWER <br />7 <br />EASEMENT AT 1770 CHATSWORTH STREET (PF12-007) <br />8 <br />WHEREAS, Kevin Miller, applicant for approval of the proposed , owns the <br />VACATION <br />9 <br />residential property at 1770 Chatsworth Street, which is legally described as: <br />10 <br />PIN: 14-29-23-34-0022 <br />11 <br />Arthur E. Thom plat, subject to sewer easement, the N half of Lot 12 <br />12 <br />WHEREAS, the Roseville Planning Commission held the public hearing regarding the <br />13 <br />proposedon May 2, 2012, voting 7-0 to recommend approval of vacating <br />EASEMENT VACATION <br />14 <br />the southern half of the existing 10-foot easement based on the comments and findings of the <br />15 <br />staff report prepared for said public hearing; and <br />16 <br />WHEREAS, the Roseville Public Works Department has determined that sewer <br />17 <br />infrastructure was never built within the easement, nor are there any plans to install sewer in that <br />18 <br />location, and has found that vacating the southern 5 feet of the easement on the subject property <br />19 <br />would not harm the public health, safety and general welfare of the community as long as the <br />20 <br />northern 5 feet of the easement is retained for drainage and utility purposes; <br />21 <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />22 <br />the requested of the southern 5 feet of the 10-foot sewer easement. <br />VACATION <br />23 <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />24 <br />Member ____ and upon vote being taken thereon, the following voted in favor: _________; <br />25 <br />and _____ voted against. <br />26 <br />WHEREUPON said resolution was declared duly passed and adopted. <br />27 <br />Page 1 of 2 <br /> <br />
