<br />Regular City Council Minutes - 10/21/02 <br />Page 14 <br /> <br />Mayor Kysylyczyn opened the Public Hearing at 7:58 p.m. <br /> <br />Jeff Gorham, 1776 Stanbridge Avenue <br />Mr. Gorham expressed his serious concerns regarding the <br />bond issue. Mr. Gorham was puzzled as to why the City <br />Council was not satisfied with the advice of its own Bond <br />Counsel. Mr. Gorham stated that the City needed good, <br />strong advice; and if the firm of Ice Miller was <br />representing Northwestern College, they couldn't represent <br />the City. Mr. Gorham further questioned the <br />unconstitutionality of the bond issue, and said he had <br />spoken to several people who indicated that if the City <br />proceeded with the bond issue, a lawsuit was very likely, <br />and that the City would likely be named in a lawsuit. Mr. <br />Gorham stated that, in the event of such litigation; he was <br />still not clear that the City would not be required to pay <br />substantial legal fees; therefore there had been no case <br />made that the issuance of such bonds was in the best <br />interest of the citizens of Roseville. <br /> <br />Joseph Machyowsky, 2690 North Oxford Street <br />Mr. Machyowsky stated that tonight's discussion <br />mitigated his concerns about the legal issues, and he <br />encouraged the City Council to give their wholehearted <br />support of the bond issue. Mr. Machyowsky further stated <br />that Northwestern College is an important and favorable <br />asset for our community. <br /> <br />Mayor Kysylyczyn closed the Public Hearing at 8:05 p.m. <br /> <br />Further discussion included the Letter of Credit <br />guaranteeing the collateral of the College; potential legal <br />ramifications to the City; and the $10,000 deposit paid to <br />the City by Northwestern College to cover legal expenses <br />to-date, including that of the City's Bond Counsel. <br /> <br />Councilmember Klausing stated he would be voting <br />against the motion, but didn't want anyone to <br />misunderstand his intent, as he was very supportive of <br />Northwestern College, agreeing that they were a valuable <br />
