<br />City Council Regular Meeting -10/23/06 <br />Minutes - Page 27 <br /> <br />wetland boundary delineation. <br /> <br />Councilmember Pust opined that she would need additional <br />information to make a determination, including where the original <br />delineation was, how did it increase in size, impacts to the <br />applicant's lot as well as adjoining lots, and would the wetland <br />have developed and enlarged naturally. <br /> <br />Councilmember lhlan reiterated her support for the Wetland <br />Preservation Act, continuing to support the Variance Board <br />variance request denial. <br /> <br />Councilmember Maschka advised that he would consider <br />additional information, opining that the City may have been <br />partially responsible for creating the situation. <br /> <br />Councilmember Kough said he would consider additional <br />information based on the original delineation. <br /> <br />Mayor Klausing concurred with Council majority; and additional <br />discussion ensued. <br /> <br />Mr. Stark clarified that the applicant would still require a <br />variance; and the basis of the hardship decision would be if there <br />was a hardship for the landowner not being able to expand the <br />house in this manner, and if they could make reasonable use, and <br />that both hardships would need to be proven. <br /> <br />Public Comment <br />Christer Cederberg, 534 Owasso Hills Drive <br />Mr. Cederberg addressed water flow down his backyard into the <br />wetland; staffs assistance in addressing significant runoff issues <br />in his backyard created by additional development in the area; and <br />opined that the City needed to take responsibility for their actions <br />to expand the lona development and not hurt others who bought <br />and developed their properties ten years ago. <br /> <br />Public Works Director Duane Schwartz addressed on-site <br />ponding; area drainage; and runoff rates. <br /> <br />Mayor Klausing opined that he would vote to deny the variance <br />
