EXTRACT OF MINUTES OF MEETING OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br /> of Roseville, County of Ramsey, Minnesota, was held on the 21st day of May 2012 at 6:00 p.m. <br /> The following Members were present: Pust, Willmus, McGehee, Johnson, and Roe; <br /> and the following Members were absent: None. <br /> Council Member Willmus introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 10986 <br /> A RESOLUTION ENUNCIATING THE EXEMPTION OF THE PROPOSED WAL- <br /> MART DEVELOPMENT AT COUNTY ROAD C AND CLEVELAND AVENUE FROM <br /> THE CITIZENS' PETITION FOR PREPARATION OF AN ENVIRONMENTAL <br /> ASSESSMENT WORKSHEET <br /> WHEREAS, a citizens' petition for an Environmental Assessment Worksheet(EAW) for <br /> the proposed Wal-Mart development at County Road C and Cleveland Avenue was submitted to <br /> the Minnesota Environmental Quality Board; and <br /> WHEREAS, the Roseville City Council is the responsible governmental unit for deciding <br /> whether an EAW is needed as a result of said citizens' petition; and <br /> WHEREAS,the Roseville City Council has reviewed the proposed Wal-Mart <br /> development, the updated Twin Lakes Alternative Urban Areawide Review(AUAR), the <br /> Minnesota Administrative Rules pertaining to environmental review, and the citizens' petition, <br /> and has made the following findings: <br /> a. The Twin Lakes AUAR was properly established and updated, and continues to be a <br /> valid environmental review instrument. <br /> b. The proposed Wal-Mart development, along with all of its associated infrastructure <br /> improvements, lies within the geographic area analyzed by the Twin Lakes AUAR. <br /> c. The proposed 160,000 square feet of retail floor area comprised by the proposed <br /> development is within the "worst case" assumptions for development of Block 4, as <br /> analyzed in Scenario A of the Twin Lakes AUAR. <br /> d. The proposed 160,000 square feet of retail floor area comprised by the proposed <br /> development is below the threshold for mandatory EAW or EIS review under MN <br /> Rules 4410.4300 and 4410.4400, respectively. <br /> e. Under Minnesota Rule 4410.3610, proposed commercial projects and associated <br /> infrastructure that fall within the geographic and analytic limits of a valid AUAR, that <br /> comply with the AUAR's plan for mitigation, and that do not exceed the threshold for <br /> mandatory preparation of an EAW are exempt from EAW requirements. <br /> Page 1 of 3 <br />
