<br />EXTRACT OF MINUTES OF MEETING OF THE <br /> <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />* * * * * * * * * * * <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br />of Roseville, County of Ramsey, Minnesota, was duly held on the 8th day of September, <br />1997, at 6:30 p.m. <br /> <br />The following members were present: Maschka, Mastel, Wiski, Goedeke, and Wall, and <br />the following were absent: None. <br /> <br />Member Mastel introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 9456 <br />RESOLUTION APPROVING DECLARATION WITH <br />EVEREST INVESTMENTS IV <br /> <br />WHEREAS, a DECLARATION (as defined in Paragraph 1) has been prepared to make <br />certain ongoing responsibilities of Everest Investments IV under that certain Development <br />Agreement with the City of Roseville, Minnesota, dated as of December 16, 1985 (the <br />"Development Agreement"), into covenants running with the land to bind future owners <br />through February 1, 2006; <br /> <br />NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Roseville, <br />Minnesota, as follows: <br /> <br />1. Recitals. <br /> <br />(a) The City of Roseville, Minnesota (the "City"), has the powers provided in <br />Minnesota Statutes, Sections 469.028, 469.048 through 469.068, and <br />469.124 through 269.134 (collectively, the "Act"). <br /> <br />(b) Pursuant to and in furtherance of the objectives of the Act, the City has <br />undertaken a program to promote development of certain land within the City <br />and in this connection is engaged in carrying out its development project <br />known as Municipal Development District No.1, Industrial Development <br />District No. 1 and Redevelopment Project Area in the City (the "Project <br />Area"). <br /> <br />(c) There has been approved by the Council, pursuant to the Act, a Municipal <br />Development Plan, Redevelopment Plan and Industrial Development District <br />NO.1 Plan for the Project Area (collectively, the "Redevelopment Plan"). <br />
