<br />City Council Regular Meeting -12/04/06 <br />Minutes - Page 28 <br /> <br />liquor, or to not open on the proposed date at all; <br /> <br />Councilmember Ihlan opined that it was the City Council's <br />duty to enforce the law; and she saw no reason to reduce <br />penalties; and further opined that if the establishments had <br />participated in the City's voluntary server training, there <br />would most likely not have been a violation. <br /> <br />Councilmember Kough reiterated that it was up to the <br />Police Chief to enforce the ordinance. <br /> <br />Councilmember Pust opined that, through some technical <br />error, paperwork didn't get finalized for one of the firms, <br />and that didn't constitute them "blowing the laws off," and <br />noted that compromises were made in litigation all the time. <br />Councilmember Pust further opined that the public was not <br />fooled by hearing that this should be handled any <br />differently; and reiterated that no one on the City Council <br />took selling liquor to minors as having minimal impact; but <br />noted that the City could come back with no punishment, <br />given the unique circumstances, and be faced with huge <br />legal bills. Councilmember Pust adamantly opined that this <br />settlement offer made sense. <br /> <br />Mayor Klausing opined, following further discussion and <br />consultation with City Attorney Anderson, that the <br />settlement offer seemed to be a reasonable compromise; but <br />that he would follow Council consensus. <br /> <br />Ihlan moved, Kough seconded, moving to not accept the <br />settlement offer as proposed. <br /> <br />Roll Call <br />Ayes: Ihlan; Kough and Klausing. <br />Nays: Pust and Maschka. <br />Motion carried. <br /> <br />9. <br /> <br />Adjourn <br />The meeting was adjourned at 8:52 p.m. <br /> <br />Adjourn <br />
