<br />City of <br /> <br />~~~ <br /> <br />City Manager Employment Agreement <br /> <br />THIS EMPLOYMENT AGREEMENT (hereinafter refened to as the "Agreement") is made and <br />entered into by and between the City of Roseville, a Minnesota municipal corporation (hereinafter refened <br />to as the "City") and William J. Malinen (hereinafter refened to as the "Manager") as of the 19th day of <br />December, 2006. <br /> <br />WHEREAS, the City wishes to engage the services of the Manager as a professional employee; and <br /> <br />WHEREAS, the parties wish to set forth the terms and conditions of their relationship in this <br />contract in order to assure the requisite flexibility to enable the Manager to function as the City's chief <br />administrative official; and <br /> <br />WHEREAS, the nature of the Manager's position requires continued professional training and <br />attendance at meetings during evenings and other non-traditional work times. <br /> <br />NOW, THEREFORE, in consideration of the mutnal covenants set forth in this agreement, the City <br />and Manager agree as follows: <br /> <br />Section 1. Emplovment. Manager shall be employed by the City as the City Manager commencing <br />on the 8th day of January, 2007. <br /> <br />Section 2. Duties. The duties of the Manager's position shall be as set forth in the job description, <br />and in accordance with state statntes and City ordinances and such other legally permissible and proper <br />duties and functions as the City Council shall from time to time assign. <br /> <br />Section 3. Dischan.!e of Duties. Manager shall be paid a salary as a FLSA exempt professional <br />employee and shall not be paid overtime for hours in excess of 40 hours per week and similarly shall be able <br />to be absent in consideration of extraordinary time expenditures. The discharge of Manager's duties requires <br />work outside the normal work day for meetings and projects. To that end, the Manager will work flexible <br />hours as is necessary to Manager to discharge the duties of his position and may be absent from the office to <br />a reasonable extent during normal work hours in consideration of extraordinary time expenditures at other <br />than normal working hours. <br /> <br />Section 4. Participation in Emplovee Benefits. <br /> <br />A) Health Insurance. The City shall provide health insurance coverage for the Manager in the <br />same fashion as it provides health insurance for fulltime non-union employees. <br /> <br />B) Life Insurance. The City shall provide life insurance coverage for the Manager in the same <br />fashion as it provides life insurance for fulltime non-union employees. <br /> <br />C) Paid Time Off (PTO). Manager shall accrue PTO bi-weekly in accordance with the <br />provision of the City's PTO policy from the first day of employment equal to 15 years service credit, which <br />is equivalent to 28 days annually. Manager shall be credited with 15 days, or 120 hours, into PTO bank at <br />the beginning of employment. All other policy guidelines will remain as stated in City policy. <br /> <br />-1- <br />
