EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 18th day of December, 2006, at 6:00 p.m. The following members were present: Ihlan, Kough, Pust, Maschka, and Mayor Klausing and the following were absent: None Council MemberKlausing introduced the following resolution and moved its adoption: RESOLUTION NO. 10460 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT IN ACCORDANCE WITH ~1005.015 AND ~1013.01 OF THE ROSEVILLE CITY CODE FOR CUMMINGS MOBILITY, 1755 COUNTY ROAD C (PF3767). WHEREAS, Cummings Mobility has requested a CONDITIUONAL USE PERMIT to establish a motor vehicle dealer at 1755 County Road C in accordance with !II 005.015 and !l1013.01 of the Roseville City Code; and WHEREAS, the subject property is legally described as: The West 500 feet of the East 2075 feet of the Southeast Quarter of Section 4, Township 29 North, Range 23 west, except the North 1737 feet thereof and except the part lying South of the centerline of County Road C PIN: 04-29-23-43-0006 WHEREAS, Section 1013 establishes the criteria for reviewing conditional use permits, which is as follows: a. Impact on traffic b. Impacts on parks, streets and other public facilities c. Compatibility of the site plan, internal circulation, landscaping and structure with contiguous properties d. Impact of the use on market value of contiguous properties e. Impact on the general public health, safety and welfare f. Compatibility with the City's Comprehensive Plan WHEREAS, The Roseville Planning Commission held the public hearing regarding the Cummings Mobility request on July 12,2006, recommending (4-1) approval of the CONDITIONAL USE PERMIT to allow the establishment of a motor vehicle dealer, subject to conditions; and 1
