CHAPTER 5 INITIATIVE, REFERENDUM AND RECALL Sec. 5.01. General voter aathority. The voters of the city shall have the right, in accordance with this charter, to propose ordinattces; and to require existin� ordinances to be submitted to a vote by processes known respectively as the initiative and referendum. Recall of elected officials shall be as proyided � state law, which requires a showing of malfeasance or nonfeasance in office. Sec. 5.02. Petitions. An initiative a�� shall be signed by registered voters of the city equal in number to �.8 10, percent of those who voted �e� in the last preceding e� neral city election. A referendum shall be si ed � registered voters of the ci equal in number to 15 ercent of voters equal in number to those who voted in the last precedin� c� neral ci election, and a recall shall he si�ned � 25 ep rcent of re;�istered voters equal in nuxnber to #hose who voted in the last precedin� e� neral ci election. Sec. 5.03. Form of petiti�on. Each petition shall be Uy a committee of iive voters whose names and addresses shall appear on the petition. The committee may request a determination from the ci attorney that the etp ition is a le;�al matter for etip tion, su, biect only to eg ttin� the reyuired number of si�natures of voters to make it complete. The ci attorney shall within ten d_ ays of such a committee request, respond in wnting io the committee with his favorable o i_p nion, or with a suggested rewording to makin� it a le�al etp ition _ A petition may consist of one or more papers, but each paper circulated separately shall contain at its head or attached to it #he statement required by 5.06 or 5.07, as the case may be. Each signer shall sign their name and give his street address. Each separate page of the petition shall have appended to it a certificate, verified by oath, that each signature is the genuine signature of the person whose name it purports to be. TIze person making the certificate shall be a resident of the city.
