<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 29th day of January 2007, at 6:00 p.m. <br /> <br />The following members were present: Roe, Kough, Pust, Ihlan, and Mayor Klausing <br />and the following were absent: None <br /> <br />Council Member Pust introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10478 <br />A RESOLUTION ELIMINATING THE PLANNED UNIT DEVELOPMENT <br />DESIGNATION FOR THE PROPERTY AT 2435 - 2459 RICE STREET (PF07-004). <br /> <br />WHEREAS, BHJN LLC (ACR Homes) seeks to eliminate the PLANNED UNIT <br />DEVELOPMENT designation placed on their property in 1987; and <br /> <br />WHEREAS, the subject property is located at 2435 - 2459 Rice Street and legally <br />described as: <br /> <br />Lot 1 and Lot 2, Block 1, Transit Addition, along with Ontlot "A" <br />PIN 12-29-23-14-0089 <br /> <br />WHEREAS, the PLANNED UNIT DEVELOPMENT designation approved in 1987 as a <br />component of a Special Use Permit granted for a gas/convenience use on the premises, does not <br />give proper direction regarding specific zoning of the parcel; and <br /> <br />WHEREAS, the Roseville Planning Division is unable to give clear guidance and direction to the <br />property owner regarding how they are able to use their property; <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />the elimination of PLANNED UNIT DEVELOPMENT DESIGNATION on the property located <br />at 2435 - 2459 Rice Street, whereby establishing the underlying and existing zoning designation <br />of Retail Business District (B-2) as the zone to guide the property in the future. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Roe and upon vote being taken thereon, the following voted in favor: Roe, Kough, <br />Pust, Ihlan, and Mayor Klausing <br />and the following voted against: None <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />1 <br />
