EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 29th day of January 2007, at 6:00 p.m. The following members were present: Roe, Kough, Pust, Ihlan, and Mayor Klausing and the following were absent: None Council Member Pust introduced the following resolution and moved its adoption: RESOLUTION NO. 10478 A RESOLUTION ELIMINATING THE PLANNED UNIT DEVELOPMENT DESIGNATION FOR THE PROPERTY AT 2435 - 2459 RICE STREET (PF07-004). WHEREAS, BHJN LLC (ACR Homes) seeks to eliminate the PLANNED UNIT DEVELOPMENT designation placed on their property in 1987; and WHEREAS, the subject property is located at 2435 - 2459 Rice Street and legally described as: Lot 1 and Lot 2, Block 1, Transit Addition, along with Ontlot "A" PIN 12-29-23-14-0089 WHEREAS, the PLANNED UNIT DEVELOPMENT designation approved in 1987 as a component of a Special Use Permit granted for a gas/convenience use on the premises, does not give proper direction regarding specific zoning of the parcel; and WHEREAS, the Roseville Planning Division is unable to give clear guidance and direction to the property owner regarding how they are able to use their property; NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE the elimination of PLANNED UNIT DEVELOPMENT DESIGNATION on the property located at 2435 - 2459 Rice Street, whereby establishing the underlying and existing zoning designation of Retail Business District (B-2) as the zone to guide the property in the future. The motion for the adoption of the foregoing resolution was duly seconded by Council Member Roe and upon vote being taken thereon, the following voted in favor: Roe, Kough, Pust, Ihlan, and Mayor Klausing and the following voted against: None WHEREUPON said resolution was declared duly passed and adopted. 1
