<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 29th day of January 2007, at 6:00 p.m. <br /> <br />The following members were present: Roe, Kough, Pust, Ihlan, K and Mayor Klausing <br />and the following were absent: None <br /> <br />Council Member Kough introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10477 <br />A RESOLUTION APPROVING A CONDITIONAL USE PERMIT IN ACCORDANCE <br />WITH ~1005.015 AND ~1013.01 OF THE ROSEVILLE CITY CODE <br />FOR CLEAR CHOICE PROPERTIES LLC AND WCL ASSOCIATES, <br />2216 COUNTY ROAD D (PF07-001). <br /> <br />WHEREAS, WCL Associates (in cooperation with Clear Choice Properties LLC, <br />Property Owner) has requested a CONDITIONAL USE PERMIT to allow for the development <br />of dual tenant stand alone structure with a single land drive-thru in the northwest corner of the <br />property in accordance with 91005.015 and 91013.01 of the Roseville City Code; and <br /> <br />WHEREAS, the subject property is located at 2216 County Road D and legally described <br /> <br />as: <br /> <br />SEE EXHIBIT "A" <br />PIN 05-29-23-12-0002 <br /> <br />WHEREAS, Section 1013 establishes the criteria for reviewing conditional use permits, <br />which is as follows: <br /> <br />a. Impact on traffic <br />b. Impacts on parks, streets and other public facilities <br />c. Compatibility of the site plan, internal circulation, landscaping and structure with <br />contiguous properties <br />d. Impact of the use on market value of contiguous properties <br />e. Impact on the general public health, safety and welfare <br />f. Compatibility with the City's Comprehensive Plan <br /> <br />WHEREAS, The Roseville Planning Commission held the public hearing regarding the <br />WCL Associates request on January 3, 2007, recommending (6-0) approval of the <br />CONDITIONAL USE PERMIT, subject to 5 conditions; <br /> <br />1 <br />
