REQUEST FOR COUNCIL ACTION <br /> Date: 06/18/2012 <br /> Item No.: <br />9.b <br />Department Approval City Manager Approval <br />Consider Change to Rental Registration Ordinance <br />Item Description: <br />1.0B <br />ACKGROUND <br />1 <br />2 <br />Staff is requesting that the City Council consider adding a section to Section 907.06 - Registration <br />3 <br />Exemptions of the Residential Rental Property Registration Ordinance that would exempt Group <br />4 <br />Homes licensed by the State of Minnesota from the rental registration requirement of the <br />5 <br />Residential Rental Property Ordinance. Additionally, staff requests that the word “notarized” be <br />6 <br />added to clarify that an affidavit filed by someone renting to a relative must be notarized. Finally, <br />7 <br />staff requests that the last sentence in the current Section 1 be moved to its own section. <br />8 <br />On March 17, 2008, the City Council approved an Ordinance requiring the registration of rental <br />9 <br />properties of 1 to 4 units. In the Ordinance, Section 907.06.1 – Registration Exemptions was <br />10 <br />included to exempt properties rented to relatives. As currently written, the exemption section does <br />11 <br />not include Group Homes licensed by the State of Minnesota. When this omission came to the <br />12 <br />attention of the Community Development Director, an administrative decision was made to exempt <br />13 <br />Group Homes licensed by the State of Minnesota from the rental registration requirement of the <br />14 <br />Rental Registration Ordinance. <br />15 <br />Additionally, it was pointed out that adding the word “notarized” would clarify to those reading the <br />16 <br />ordinance that affidavits must be notarized. <br />17 <br />With regard to the Section 907.06 - Registration Exemptions, staff requests the addition of a <br />18 <br />section that exempts Group Homes licensed by the State of Minnesota, the addition of the word <br />19 <br />“notarized,” and a section to clarify that if an exemption is no longer applicable and a property is a <br />20 <br />rental, the property owner must register the property within 30 days: <br />21 <br />22 <br />wner of a rental dwelling unit is exempted <br />907.06.
