<br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />the request by Starbucks Coffee (in cooperation with Kimco Realty, property owner) for a <br />CONDITIONAL USE PERMIT in accordance with Section 1013.01 of the Roseville City Code, <br />subject to the following conditions; <br /> <br />1. The Starbucks site shall be developed in accordance with the plans dated 01/08/07 and/or <br />as required by the Roseville Planning staff to appropriately accommodate large delivery <br />trucks and facilitate on-site vehicle movements (per traffic study recommendations). <br /> <br />2. The property owner (Kimco Realty) shall submit a shared access/use easement or a <br />written agreement for vehicle use (specific to semi-trucks) for review and approval by the <br />City of Roseville, which document must be recorded (on both the Kimco property as well <br />as the Sports Authority property) prior to the issuance of the Certificate of Occupancy for <br />the site. <br /> <br />3. The trash enclosure must meet all requirements of S 1010 (Design Standards), specifically <br />constructed of similar material to that of the structure and must include a roof. <br /> <br />4. The applicant must submit a revised grading/drainage plan to the Roseville City Engineer <br />for review and approval. Also this Plan must receive proper approval from the Rice <br />Creek Watershed. <br /> <br />5. The applicant must submit a landscape plan consistent with the Roseville City Code, <br />specifically including a mixture of trees, shrubs and perennials similar to those previously <br />supported on other areas of the site. <br /> <br />6. The applicant must submit a revised overall site plan to the City Planner for review and <br />approval that addresses large delivery truck conflicts as noted in the SEH traffic study. <br /> <br />7. The conditional use permit shall expire within six months of the date of City Council <br />approval if a building permit is not obtained for the approved development (Section <br />1013.03 of the City Code). <br /> <br />8. The conditional use permit shall expire within 6 months of the date of City Council <br />approval if a building permit is not obtained for the approved development (s 1 013.03 of <br />the City Code). <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Pust and upon vote being taken thereon, the following voted in favor: Roe, Pust, and <br />Mayor Klausing <br />and the following voted against: Ihlan and Kough <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />2 <br />
