<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Coum:il of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 7th day of May 2007, at 6:00 p.m. <br /> <br />The following members were present: Roe, Kough, Ihlan, Pust, and Klausing; <br /> <br />and none were absent. <br /> <br />Council Member Roe introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10498 <br /> <br />A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AMENDMENT IN <br />ACCORDANCE WITH ~1005.015 AND ~1013.01 OF THE ROSEVILLE CITY CODE <br /> <br />FOR JOE STRANIK AND MIDAS AT 2168 SNELLING AVENUE (PF07-019) <br /> <br />WHEREAS, Joe Stranik has requested a CONDITIONAL USE PERMIT AMENDMENT <br />to allow for the operation of an automobile service station the subject premises, in accordance <br />with 91005.015 and 91013.01 of the Roseville City Code, without requiring further City Council <br />approvals for changes to the colors of paint on the fascia; and <br /> <br />WHEREAS, the subject property is located at 2168 Snelling Avenue and is legally <br />described as: <br /> <br />SECTION 10 TOWNSHIP 29 RANGE 23, SUBJECT TO STATE IDGHWAY 51/125 AND <br />COUNTY ROAD B, THE SOUTH 183 FEET OF THE WEST 367 FEET OF THE <br />SOUTHWEST 1/4 OF SECTION 10 TOWNSIDP 29 RANGE 23 <br /> <br />WHEREAS, the existing automobile service station use is operating under a valid <br />Conditional Use Permit; and <br /> <br />WHEREAS the existing Conditional Use Permit approved and prohibited specific color <br />options for the non-brick building exterior (i.e., the fascia); and <br /> <br />WHEREAS 91013.01H of the Roseville City Code allows amendments to the conditions <br />of a Conditional Use Permit to be administratively approved if the proposed changes deviate less <br />than 10% from the approved conditions; and <br /> <br />WHEREAS, a change of color is not technically a change of less than 10%; <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />the request by Joe Stranik for a CONDITIONAL USE PERMIT AMENDMENT, in accordance <br />with Section 1013.01 of the Roseville City Code, affirming the existing automobile service <br />station use and eliminating the prohibition/approval of specific colors for the fascia. <br /> <br />Page 10f3 <br />
