University may comment separately on said results and <br />141 <br />reports to any regulatory agency, but shall not alter any submission from Licensee to any <br />142 <br />regulatory agency. <br />143 <br />144 <br />3.6 Upon completion of Licensee’s Work, the Project and all improvements related <br />145 <br />thereto shall be owned, operated and maintained by University. <br />146 <br />147 <br />4. Environmental. <br />148 <br />149 <br />4.1 Licensee shall not—and shall ensure that its contractors and consultants do not— <br />150 <br />release, install, use, generate, store, locate, produce, process, treat, transport, incorporate, <br />151 <br />discharge, emit, deposit, or dispose of Hazardous Substances in, upon, under, over or from the <br />152 <br />University Property or violate any Environmental Laws on or near the University Property. <br />153 <br />154 <br />4.2 Definitions. <br />155 <br />156 <br />Environmental Laws <br />4.2.1 “” means any and all federal, state, local, or <br />157 <br />municipal laws, rules, orders, regulations, statutes, ordinances, codes, decrees, or <br />158 <br />requirements of any governmental authority regulating, relating to, or imposing liability <br />159 <br />or standards of conduct concerning any Hazardous Substances, environmental protection, <br />160 <br />or health and safety, as now or may at any time hereafter be in effect and as amended <br />161 <br />from time to time, as well as the regulations adopted and promulgated thereunder, <br />162 <br />including without limitation: the Clean Water Act, also known as the Federal Water <br />163 <br />Pollution Control Act, 33 U.S.C. Section 1251 et seq.; the Clean Air Act, 42 U.S.C. <br />164 <br />Section 7401 et seq.; the Federal Insecticide, Fungicide, and Rodenticide Act, 7 U.S.C. <br />165 <br />Section 136 et seq.; the Comprehensive Environmental Response, Compensation, and <br />166 <br />Liability Act, 42 U.S.C. Section 9601 et seq.; the Superfund Amendments and <br />167 <br />Reauthorization Act of 1986, Public Law 99-499, 100 Stat. 1613; the Emergency <br />168 <br />Planning and Community Right to Know Act, 42 U.S.C. Section 11001 et seq.; the <br />169 <br />Resource Conservation and Recovery Act, also known as the Solid Waste Disposal Act, <br />170 <br />42 U.S.C. § 6901 et seq.; and the Minnesota Environmental Response and Liability Act, <br />171 <br />Minnesota Statutes Chapter 115B. <br />172 <br />173 <br />Hazardous Substance <br />4.2.2 “” means (i) hazardous materials, hazardous <br />174 <br />wastes, and hazardous substances as those terms are defined under any Environmental <br />175 <br />Laws; (ii) petroleum, petroleum products, and by-products, including crude oil and any <br />176 <br />fractions thereof; (iii) natural gas, natural gas liquids, liquefied natural gas, synthetic gas, <br />177 <br />and any mixtures thereof; (iv) asbestos or any material that contains any hydrated <br />178 <br />magnesium silicate minerals that crystallize as bundles of long, thin fibers that readily <br />179 <br />separate when broken or crushed; (vi) radon; (vii) any other hazardous or radioactive <br />180 <br />substance, material, contaminant, pollutant, or waste; (viii) any substance with respect to <br />181 <br />which any federal, state, or local Environmental Law or governmental agency requires <br />182 <br />environmental investigation, monitoring ,or remediation; and (ix) any other substance or <br />183 <br />4 <br /> <br />
