4.0B <br />ACKGROUND <br />11 <br />4.1The subject property has a Comprehensive Plan Land Use Designation of Industrial (I) <br />12 <br />and a corresponding zoning classification of Industrial (I) District. The <br />PRELIMINARY <br />13 <br />proposal has been prompted by plans to develop an approximately 60,000-square- <br />PLAT <br />14 <br />foot office/warehouse facility on the proposed Lot 1; the ultimate use for Lot 2 remains <br />15 <br />undetermined at this time. <br />16 <br />4.2When exercising the so-called “quasi-judicial” authority when acting on a request, <br />PLAT <br />17 <br />the role of the City is to determine the facts associated with a particular request and apply <br />18 <br />those facts to the legal standards contained in the ordinance and relevant state law. In <br />19 <br />general, if the facts indicate the applicant meets the relevant legal standard, then they are <br />20 <br />likely entitled to the approval, although the City is able to add conditions to a plat <br />21 <br />approval to ensure that the likely impacts to roads, storm sewers, and other public <br />22 <br />infrastructure on and around the subject property are adequately addressed. <br />23 <br />5.0PPA <br />RELIMINARYLATNALYSIS <br />24 <br />5.1Plat proposals are reviewed primarily for the purpose of ensuring that all proposed lots <br />25 <br />meet the minimum size requirements of the zoning code, that adequate streets and other <br />26 <br />public infrastructure are in place or identified and constructed, and that storm water is <br />27 <br />addressed to prevent problems either on nearby property or within the storm water <br />28 <br />system. As a of an industrial property, the proposal leaves no zoning <br />PRELIMINARY PLAT <br />29 <br />issues to be addressed since the Zoning Code does not establish minimum lot dimensions <br />30 <br />or area. The proposed is included with this report as Attachment C. <br />PRELIMINARY PLAT <br />31 <br />5.2Roseville’s Public Works Department staff have been working with the applicant to <br />32 <br />address the typical public needs related to easements as well as the overall site grading <br />33 <br />and attending to storm water management requirements. <br />34 <br />5.3Roseville’s Parks and Recreation Commission reviewed the proposed <br />PRELIMINARY PLAT <br />35 <br />against the park dedication requirements of §1103.07 of the City Code at its meeting on <br />36 <br />September 15, 2012. After reviewing the proposal, the Parks and Recreation Commission <br />37 <br />recommend requiring a dedication of cash in lieu of land in this location; the total cash <br />38 <br />dedication would be $77,115. <br />39 <br />6.0PC <br />UBLICOMMENT <br />40 <br />The duly-noticed public hearing for this application was held by the <br />PRELIMINARY PLAT <br />41 <br />Planning Commission on September 5, 2012; draft minutes of the public hearing are <br />42 <br />included with this report as Attachment D. Planning Division staff had received one <br />43 <br />clarifying question about the proposal received vie email at the time this report was <br />44 <br />prepared, but no comments have thus far been received. <br />45 <br />7.0R <br />ECOMMENDATION <br />46 <br />Based on the comments and findings outlined in Sections 4 – 6 of this report, the <br />47 <br />Planning Division and Public Works Department concur with the recommendation of the <br />48 <br />Planning Commission to approve the proposed pursuant to Title 11 of <br />PRELIMINARY PLAT <br />49 <br />the Roseville City Code with the following conditions: <br />50 <br />a. <br />the applicant continue working with the Public Works Department to address <br />51 <br />easement and storm water infrastructure requirements as necessary; and <br />52 <br />PF12-013_RCA_092412 <br />Page 2 of 3 <br /> <br />
