1less than the actual costs incurred by the City in connection with the City Work, the <br />2Applicants shall pay to the City the amount of the deficiency within 10 days after being <br />3notified by the City of same. Interest on the amount of any deficiency not paid within <br />4said 10 day period shall thereafter accrue at a rate of 6% per annum. <br />5 <br />65.No interest shall accrue to the Applicants, or be payable by the City, on the Escrow <br />7Amount. <br />8 <br />96.The Applicants agree to pay the City for any attorney’s fees and court costs incurred by <br />10the City in the enforcement of this Agreement. <br />11 <br />127.The City shall provide the Applicants an accounting of the balance remaining and <br />13amounts drawn from the Escrow Amount upon written request of the Applicant, provided <br />14such requests shall not be made more frequently than on a monthly basis. <br />15 <br />168.The City shall not be responsible to the Applicants for the quality or content of the <br />17Consultant’s Work. <br />18 <br />199.The provisions of this Agreement shall run to the benefit of the City of Vadnais Heights, <br />20and its successors and assigns, and shall be binding upon the Applicants, and the <br />21Applicants successors and assigns.
