REQUEST FOR COUNCIL ACTION <br /> Date: 9/24/12 <br /> Item No.: 11.a <br />Department Approval City Manager Approval <br />Item Description: Public Hearing for a 2011 Project to be assessed in 2012 <br />B <br />ACKGROUND <br />1 <br />On August 20, 2012, the City Council set a date to hold a public hearing for the purpose of <br />2 <br />establishing special assessments for City Project P-ST-SW-11-02: Dale Street Reconstruction, <br />3 <br />between County Road C and S. Owasso Blvd. It is suggested that the public hearing be <br />4 <br />conducted according to the attached agenda. <br />5 <br />At the assessment hearing, staff will go through a brief presentation that will include a <br />6 <br />description of the project, project financing, and a discussion of typical assessments for <br />7 <br />properties benefiting from these improvements. Staff will summarize the City assessment policy <br />8 <br />and how it has been applied to this project. <br />9 <br />It is suggested that if property owners have individual concerns about the quality of construction <br />10 <br />as part of the project or specific information about project deficiencies, these should be referred <br />11 <br />to the Engineering Department. Typically, these kinds of complaints relate to quality of finished <br />12 <br />construction and are covered under the warranty. The warranty is one year from the final <br />13 <br />contract acceptance; the Contract was finalized on July 16, 2012. Correction of these types of <br />14 <br />problems should not delay the adoption of assessment rolls. <br />15 <br />Following past Council policy, if questions are brought up during the Public Hearing regarding <br />16 <br />specific assessments, if amendments to the assessment rolls are necessary, or if Council would <br />17 <br />like staff to investigate a concern, the hearing can be continued to the next council meeting. <br />18 <br />This project has been completed in accordance with the plans and specifications and there are no <br />19 <br />problems with construction according to our final review. <br />20 <br />PO <br />OLICYBJECTIVE <br />21 <br />It is the City’s policy to assess for a portion of street reconstruction costs. The assessment roll <br />22 <br />has been prepared in accordance with state statute Chapter 429 and Roseville's assessment <br />23 <br />policy. The roll and frontages are consistent with the recommendations in the feasibility report <br />24 <br />prepared for this project. <br />25 <br />After the Public Hearing, the City Council adopts the assessment roll making it final. The City <br />26 <br />allows for a 30-day pre-payment period after the roll adoption. Following the pre-payment <br />27 <br />period, assessment rolls are certified to Ramsey County for collection. The City will have the <br />28 <br />rolls certified by early November in order to allow the County enough time to add the <br />29 <br />assessments to property taxes. <br />30 <br />FI <br />INANCIALMPACTS <br />31 <br />Attachment A is a Project Financing Summary detailing the feasibility report and actual project <br />32 <br />costs for this improvement.
