� <br />� <br />2. Criteria: In deterinining whether or no� a person is <br />eligible fo�erral of special assessment installment payments� <br />the follow�ng c�zteria are established: <br />A. Senior Cit�zens, <br />(1) Senior ci�a.zens speciaZ assessment hard- <br />ship deferral applies to special assessments <br />Ievied after June 27, 1977. <br />(2) Senior citizen special assessment hard- <br />ship deferral appli�s to qualifying special. <br />assessments against a�1 properties classified <br />as "homesiead" pursuant to Mznn. Stat. Chapter <br />273, where one ox-Fnore of the owners of such <br />property is 65 years ot age or oldex and i� <br />would create a hardship for the owne-r or owners <br />of the property to pay the specia]. assessment <br />instal�ments as th�y becon�e due. . <br />(3} The senior citizen sha11 be required to <br />prove eligibility for this special assessment <br />deferral on the basis of age. <br />B. Persons Retired by Virtue of Permanen� and Total <br />Disability. <br />(1} The special assessment hazdship defer-- <br />ral for persons retired by virtue af permanent <br />and total disability applies to special assess- <br />ments levied after the date of th� adoption of <br />this resoZution. <br />(2) This special. assessment hardship defer- <br />ral applies to qualifying special assessments <br />against all propertzes classiiied as "homestead" <br />pursuant to Minn. Stat. Chapter 273 where one or <br />more of the owners of such prop�rty is retired <br />by virtue of a permanent and to�ai disabili�y and <br />it wouZd cxeate a haraship for the owner or <br />owners of the property to pay ihe special assess- <br />ment installments as they become due. <br />(3} It shall be presumed that a property <br />owner is xetired from employment by vi.rtue of a <br />permanent and total disability i�: <br />(a) The individual has in fact re- <br />tired �rom employmen�; and <br />(b) The individual suffers �rom �he <br />total and permanent loss of the szght <br />of both �yes, the loss of both arms at <br />the shoulder, the Ioss of both legs so <br />clo se to the hips that no effective <br />2 <br />
