PLANNING FILE 07-006 1 <br />Request by United Properties for approval of VACATION and rededication of a drainage easement 2 <br />to accommodate the final phase of development at 1996 Langton Lake Drive 3 <br />Chair Boerigter opened the Public Hearing fo r File 07-006 at approximately 6:33 p.m. 4 <br />Associate Planner Bryan Lloyd briefly reviewed the request of United Properties for vacation of an 5 <br />existing drainage and utility easement and rededication of a new easement to facilitate Phase II of the 6 <br />Applewood Pointe at Langton Lake senior cooperati ve residential development, adjacent to 1996 Langton 7 <br />Lake Drive. 8 <br />Mr. Lloyd advised that the Public Works/Enginee ring staff had reviewed the proposed vacation and 9 <br />rededication of the drainage and utility easement as illustrated; and the only condition for approval 10 <br />recommended is that the applicant continue to work wi th Public Works staff to ensure that the permanent 11 <br />storm water facilities and new drainage easem ent are appropriately designed and dedicated. 12 <br />Discussion included distinctions between tempor ary drainage and easement compared to permanent 13 <br />design during and after construction. 14 <br />Chuck Plowe, Applicant Representative 15 <br />Mr. Plowe was present in the audience; however, he had no additional comments beyond concurring with 16 <br />staff’s presentation. 17 <br />Chair Boerigter closed the Public Hearing for File 07-006 at approximately 6:37p.m.; with no one 18 <br />appearing for or against. 19 <br />MOTION 20 <br />Member Boguszewski moved, seconded by Member Boerigter to recommend to the City Council 21 <br />APPROVAL of a VACATION of the drainage easement; based on the comments and findings of 22 <br />Sections 4-6 and the recommendation of Section 7 of the staff report dated November 7, 2012 23 <br />Ayes: 4 24 <br />Nays: 0 25 <br />Motion carried. 26 <br />Attachment D <br />Page 1 of 1
