Public Hearing 923 PLANNING FILE 12-001 924 Request by Roseville Acquisitions, LLC, Roseville Acquisitions Three, LLC, and Roseville 925 Properties for approval of VACATION of certain public roadway interest in two (2), ten-foot 926 (10’) wide strips of land, comprising part of the former Mount Ridge Road that were 927 previously deeded to the applicants concurrent with the 2009 vacation of the adjacent, 928 dedicated Mount Ridge Road Right-of-Way 929 Chair Boerigter opened the Public Hearing for File 12-001 at approximately 9:20 p.m. 930 Associate Planner Bryan Lloyd briefly summarized the requested action vacating the existing 931 roadway easements that cross several of the parcels in the NE quadrant of the intersection of 932 County Road C and Cleveland Avenue. Mr. Lloyd advised that the Public Works Department staff 933 recommended approval of the proposed EASEMENT VACATION; as detailed and specifically 934 based on Section 8 of the staff report dated July 11, 2012. 935 At the request of Member Strohmeier, Mr. Lloyd reviewed the purpose of this action to clear 936 platting of rights-of-way and Ramsey County records to vacate any perceived encumbrance of the 937 ten foot (10’) strips of land already owned by Roseville Properties through previous action. Mr. 938 Lloyd advised that this formalized the City’s intent to vacate their interest. 939 City Planner Paschke advised that the previous City Attorney had determined at the time that 940 there was no need to vacate the strips and to simply deed the land back to the property owners. 941 However, Mr. Paschke advised that this served to clean up any remaining public interest for the 942 record from that original 2009 vacation. 943 At the request of Member Strohmeier, Mr. Paschke assured Commissioners that there were no 944 planned utilities and no anticipation of connecting Mount Ridge Road to County Road C, as the 945 Prior Avenue and Twin Lakes Parkway network was intended for that Twin Lakes Redevelopment 946 Area. Mr. Paschke noted that the original encumbrance, probably in 2001, had reserved the rights- 947 of-way before infrastructure had been clearly defined. 948 Chair Boerigter closed the Public Hearing for File 12-001 at approximately 9:29 p.m., with no one 949 speaking for or against. 950 MOTION 951 Member Boguszewski moved, seconded by Member Lester to recommend to the City 952 Council APPROVAL OF THE VACATION OF ALL ROADWAY INTERESTS IN THE TWO (2) 953 AREAS IDENTIFIED IN THE REQUEST; based on the comments and findings of Sections 4- 954 6 and the recommendations of Section 7 of the staff report dated July 11, 2012. 955 Ayes: 6 956 Nays: 0 957 Motion carried. 958 Staff advised that anticipated date of City Council action was undetermined at this time. 959 5.
