Public Hearing <br />923 <br />PLANNING FILE 12-001 <br />924 <br />Request by Roseville Acquisitions, LLC, Roseville Acquisitions Three, LLC, and Roseville <br />925 <br />Properties for approval of VACATION of certain public roadway interest in two (2), ten-foot <br />926 <br />(10’) wide strips of land, comprising part of the former Mount Ridge Road that were <br />927 <br />previously deeded to the applicants concurrent with the 2009 vacation of the adjacent, <br />928 <br />dedicated Mount Ridge Road Right-of-Way <br />929 <br />Chair Boerigter opened the Public Hearing for File 12-001 at approximately 9:20 p.m. <br />930 <br />Associate Planner Bryan Lloyd briefly summarized the requested action vacating the existing <br />931 <br />roadway easements that cross several of the parcels in the NE quadrant of the intersection of <br />932 <br />County Road C and Cleveland Avenue. Mr. Lloyd advised that the Public Works Department staff <br />933 <br />recommended approval of the proposed EASEMENT VACATION; as detailed and specifically <br />934 <br />based on Section 8 of the staff report dated July 11, 2012. <br />935 <br />At the request of Member Strohmeier, Mr. Lloyd reviewed the purpose of this action to clear <br />936 <br />platting of rights-of-way and Ramsey County records to vacate any perceived encumbrance of the <br />937 <br />ten foot (10’) strips of land already owned by Roseville Properties through previous action. Mr. <br />938 <br />Lloyd advised that this formalized the City’s intent to vacate their interest. <br />939 <br />City Planner Paschke advised that the previous City Attorney had determined at the time that <br />940 <br />there was no need to vacate the strips and to simply deed the land back to the property owners. <br />941 <br />However, Mr. Paschke advised that this served to clean up any remaining public interest for the <br />942 <br />record from that original 2009 vacation. <br />943 <br />At the request of Member Strohmeier, Mr. Paschke assured Commissioners that there were no <br />944 <br />planned utilities and no anticipation of connecting Mount Ridge Road to County Road C, as the <br />945 <br />Prior Avenue and Twin Lakes Parkway network was intended for that Twin Lakes Redevelopment <br />946 <br />Area. Mr. Paschke noted that the original encumbrance, probably in 2001, had reserved the rights- <br />947 <br />of-way before infrastructure had been clearly defined. <br />948 <br />Chair Boerigter closed the Public Hearing for File 12-001 at approximately 9:29 p.m., with no one <br />949 <br />speaking for or against. <br />950 <br />MOTION <br />951 <br />Member Boguszewski moved, seconded by Member Lester to recommend to the City <br />952 <br />Council APPROVAL OF THE VACATION OF ALL ROADWAY INTERESTS IN THE TWO (2) <br />953 <br />AREAS IDENTIFIED IN THE REQUEST; based on the comments and findings of Sections 4- <br />954 <br />6 and the recommendations of Section 7 of the staff report dated July 11, 2012. <br />955 <br />Ayes: 6 <br />956 <br />Nays: 0 <br />957 <br />Motion carried. <br />958 <br />Staff advised that anticipated date of City Council action was undetermined at this time. <br />959 <br />5.
