Regular City Council Meeting <br /> Monday,November 19, 2012 <br /> Page 7 <br /> Nays: None. <br /> 8. Consider Items Removed from Consent <br /> d. Request by United Properties for Approval of Vacation and Rededication <br /> of a Drainage Easement to Accommodate the Final Phase of Development <br /> at 1996 Langton Lake Drive <br /> At the request of Mayor Roe, City Manager Malinen briefly reviewed this re- <br /> quest, as detailed in the Request for Council Action (RCA) dated November 19, <br /> 2012. <br /> Councilmember McGehee questioned the condition of approval recommended <br /> by staff(Section 7.0 of the RCA) and whether approval of the Rice Creek Wa- <br /> tershed District (RCWD) would still be applicable. <br /> City Engineer Debra Bloom advised that staff had been and continued to work <br /> with United Properties on drainage for the site. Ms. Bloom noted that since the <br /> next phase of the development was new, a new RCWD permit would also be re- <br /> quired; and as always, assured the City Council and public that it would be in <br /> compliance with best management practices as outlined by RCWD require- <br /> ments. <br /> Councilmember McGehee advised that her intent was to make sure that approv- <br /> al authority was not disregarded. <br /> Mayor Roe noted that neither the City of the applicant could do so from a statu- <br /> tory level. <br /> McGehee moved, Johnson seconded, adoption of Resolution No.11022 entitled <br /> "A Resolution Approving the Vacation of a Portion of the Drainage and Utility <br /> Easement at Applewood Pointe of Langton Lake (PF07-006)." <br /> Ms. Bloom clarified the parameters of this action, with Engineering/Public <br /> Works staff and the developer continuing to work together on a new drainage <br /> easement; noting that this action was not approving that new easement at this <br /> time. <br /> Roll Call <br /> Ayes: Johnson; McGehee; Willmus; and Roe. <br /> Nays: None. <br /> g. Twin Lakes Overlay Ordinance Repeal <br /> At the request of Mayor Roe, City Manager Malinen briefly reviewed this re- <br /> quest, as detailed in the Request for Council Action (RCA) dated November 19, <br /> 2012. <br />
