RETH INK Op <br />RECYCLING® <br />Regional Strategies <br />Regulation <br />A. Introduction <br />The metropolitan counties are required by state law to regulate solid and hazardous <br />waste. Each county has developed ordinances and Master Plans to define the steps <br />that will be taken to affirm that solid and hazardous waste generators and facilities <br />are regulated, that waste is managed in accordance with federal, state and local <br />requirements and that the objectives of the Master Plan are met. The ordinances <br />also specify the enforcement actions that may be used to gain compliance. <br />Note: For additional information regarding specific solid waste regulations within <br />each SWMCB member county, please consult the individual county Master Plans <br />that are being submitted concurrently with the Regional Master Plan. <br />The SWMCB does not have regulatory authority on behalf of its member counties, <br />and previous editions of the Regional Master Plan therefore did not include any <br />specific solid waste regulation strategies. However, with some of the available state <br />and regional solid waste management regulatory tools not being fully utilized and a <br />desire by SWMCB to expand some regulatory efforts throughout the Region, <br />SWMCB opted to include regional and partnership strategies for regulation in the <br />2011 Regional Master Plan for the first time. <br />B. Regional Hauler Licensing <br />Established in 1995, the regional hauler licensing program was designed so the <br />metropolitan counties can, through a collaborative effort, issue mixed municipal <br />solid waste hauler collection and transportation licenses. The program provides for <br />the issuance of one base license by the county in which the hauler is based and an <br />operating license by each county in which a hauler operates. The base license <br />provisions, including insurance requirements, fees, hauler application form and <br />license year, are consistent throughout the Region. The SWMCB establishes the <br />requirements for the application process and encourages uniform enforcement <br />guidelines be carried out by the counties. However, the counties are the regulatory <br />authorities responsible for licensing haulers and enforcing licensing requirements. <br />C. Hazardous Waste Licensing <br />Each metropolitan county licenses and inspects hazardous waste generators and <br />facilities pursuant to hazardous waste ordinances. Because of the differences in <br />population, priorities, and resources, the number of licenses issued and inspections <br />conducted varies among the counties.
