BACKGROUND <br />1� The updated Zoning Ordinance went into effect on December 21, 2010, and since <br />�i � that date the Planning Division has been monitoring all the different nuances of <br />� i� this broad document. <br />�� One area that has come to the forefront is the Regional Business District <br />�� established north and west of Rosedale Mall. Since the adoption of the zoning <br />20 ordinance, the Planning Division has been challenged in this area regarding non- <br />2� conforming use. Such changes are creating limitation on use and reinvestment <br />2� within certain structures. <br />2.; I have identified four parcels (1901 (Caterpillar), 1975 (multi-tenant), 1995 <br />2�� (multi-tenant) County Road B2, and 2452 (UV Color) Prior Avenue) which have <br />2�:; operated in a light industrial manner for many years. Prior to the changes of 2009 <br />26 (Comp Plan) and 2010 (Zoning Ordinance), these parcels were zoned I-1, Light <br />2�' Industrial and most of the buildings have had varying degrees of light <br />2� manufacturing or limited production and processing. <br />2a However, the 2009 and 2010 changes to Regional Business has created a number <br />3�� of non-conforming use issues/concerns — specifically the eliminated one of the <br />�� predominant and critical uses within these buildings and has/is hampering or <br />32 restricting reinvestment. <br />3? From a Planning Division perspective, the Comprehensive Plan Update Process <br />3��� did not delve into the finite details of each use within the above noted structures. <br />�� Instead, the process looked at what was at that time occurring in the area and what <br />a�� it deemed to be in the best interest of the community, and sought the land use and <br />`?t subsequent zoning changes from light industrial to regional business. <br />3c; STAFF ANALYSIS/RECOMMENDATION <br />s� For the past couple of months, the City Planner has monitored the County Road <br />�� B2, Prior Avenue and area Oakcrest Avenue sites, reviewed historical <br />4� information, and discussed the previous land use and zoning change with a few <br />4� property owners to better under the effects and impacts the changes have made. <br />4� Since the uses that the Planning Division foresees in this area are mostly not new, <br />4� the proposed amendment did require some analysis for the purpose of potential <br />4_�; impact comfort. The Panning Division has concluded that such a use, limited <br />�! � production and processing, being added into the mix of permitted uses in the <br />�:� Regional Business District would not dramatically change that which could <br />�t� currently be places within the district. <br />�� As currently defined in the Code, Limited Production and Processing is as <br />5c follows: <br />5^ Limited production/processing: Light manufacturing, fabrication, assembly, <br />�2 processing, packaging, research, development, or similaN uses which are <br />�� predominately conducted indoors and which would not be disruptive of,� or <br />�. incompatible with, other office, retail, or service uses that may be in the same <br />Amdt6 RCA_102212 (3) <br />Page 2 of 3 <br />
