����r°����t;����a�� �..a���:���' �."�����a��������,�� ,-���. ���°���;rro3��� Attachment A <br />Grant No. SGOQ7-121 <br />Grant No. SG007-143 <br />Grant No. SG009-079 <br />Agreement Requiring Repayment of <br />Metropolitan Liva�le Communities Act Grant Funds <br />Made Available as Loans to the Sienna Green Project in Roseville <br />THIS AGREEMENT is made and entered into by ti�e Metropolitan Council (the "Council") and <br />the City of Roseville (the "City"). <br />WHEREAS, in 2007 the Council awarded the City two Metropolitan Livable Comrnunities Act <br />("LCA") grants to help fi.�nd the first phase of the City's Sienna Green project (the "ProjecY'), <br />formerly known as the Har Mar Apartments project; and <br />W�IEREAS, Grant No. SG007-12 [(as amended on October 7, 2009) made $305,000.00 in i�ivable <br />Communities DemonstraYion Accaunt ("LCDA") grant funds availabEe to the City far the Project; <br />and <br />WHEREAS, Grant No. SG007-143 (as amended on October 7, 2009) made $121,500.00 in Tax <br />Base Revitalization Account ("TBRA") grant funds available to the City for the Project; and <br />WHEREAS, in late 2009 and early 2010 the Council incorporated into its LCA grant agreements <br />provisions that authorize LCA grantees to make LCA grant funds available as loans to project <br />owners so the owners can take advantage of federal and state low-income housing tax credit <br />programs; and <br />WHEREAS, LCA grantees' ability to make grant funds availabEe as loans to project owners is <br />subject to certain terms and conditions stated 'rn the LCA grant agreements; and <br />WHEREAS, on January 13, 20 l 0 the Council awarded the City a$202, i 00.00 LCDA grant (Grant <br />�Io. SG009-079) for the second phase of the City's Project; and <br />WHEREAS, Grant No. SG009-0'79 was amcnded on Decembcr 9, 20l 1 and August 3, 2012; and <br />WHEREAS, Section 2.03 of Grant No. SG009-079 authorized the City to make the LCUA grant <br />funds available as a loan to the Project if the City's LCA grant application indicated the City <br />intended to use the grant funds as a loan or if the City requested in writing perrnission to ase the <br />grant funds as a loan to the Project, and it stated other terms and conditions that applied if the City <br />structured the grant assistance to the Project as a loan; and <br />WHEREAS, Grant Nos. SG007-121, SG007-143 and SG009-079 (as amended) expired and have <br />been closed out; and <br />WHEREAS, on September 12, 2012 the City informed the Council that the grant funds from Grant <br />Nos. SG007-121, SG007-]43 and SG009-079 were "loaned" to the Project owner so the owner <br />could qualify for low-income tax credits. <br />Page 1 of'3 Pages <br />
