Attachment B <br />� PUBLIC IMPROVEMENT CONTRACT <br />2 [APPLEWOOD POINTE OF ROSEVILLE AT LANGTON LAKE — PHASE IIJ <br />3 <br />4 <br />5 I. Parties. This Agreement, dated , 2013, is entered into between the City of <br />6 Roseville, a Minnesota municipal corporation, of 2660 Civic Center Drive, Roseville, Minnesota <br />7 55113 ("the City"), and United Properties Residential LLC, a Minnesota limited liability <br />8 company, of 3500 American Boulevard West, Suite 200, Bloomington, MN 55431 ("the <br />9 Developer"). <br />lo IL Plat Approval. The City previously approved a plat of land known as `Applewood Pointe of <br />u Roseville at Langton Lake "(also referred to in this Agreement as the "Plat"). The land is legally <br />12 described as follows: <br />13 See Legal Descriprion attached as Exhibit A hereto ("Property") <br />14 <br />15 III. Terms and Conditions of Construction of Public Improvements. In reliance upon the <br />16 representations contained herein, and in consideration of the mutual undertakings herein <br />17 expressed, the parties agree as follows: <br />18 A. Compliance with Laws: The Developer shall comply with any and all applicable City, County, <br />19 Metropolitan, State and Federal laws and regulations including, but not limited to: subdivision <br />20 ordinances, zoning ordinances and environmental regLllations that may apply to the Plat, the <br />21 development of the property contained in the Plat, and the construction of the Phase II Public <br />22 Improvements described below. <br />23 B. Land Use: The proposed land use for the Property consists of a senior cooperative building to be <br />24 built in two phases. Phase I, consisting of 48 apartment-style cooperative units, has been completed. <br />25 Phase II will comprise an extension to the cooperative building consisting of an additiona141 <br />26 apartment-style cooperative units. As part of Phase II of the project, certain storm sewer <br />27 improvements in the area as shown on Exhibit B hereto, will be modified as shown on Exhibit C <br />2g hereto (the "Phase II Public Improvements"). <br />29 C. Phase II Public Improvements. The Developer shall construct the following Phase II Public <br />3o Improvements in compliance with plans and specifications approved by the City: <br />31 1. Storm Sewer Improvements. The Developer shall construct a retention pond and <br />32 underground detention system as shown on Exhibit C hereto, in accordance with City <br />33 details, specifications and the Plans described in Section III D below. <br />34 2. Erosion control. Prior to site grading and before any construction is commenced or <br />35 building permits are issued, the erosion control plan shall be implemented, inspected and <br />36 approved by the City. The Developer shall meet all requirements of the City's Erosion <br />37 Control Ordinance including but not limited to the following: <br />3s a) No construction activity shall be allowed and no building permits shall be issued <br />39 unless the Property is in full compliance with the erosion control requirements. <br />40 b) Erosion Control Measures shall be installed in compliance with MPCA NPDES <br />41 permit requirements. <br />42 c) The City shall inspect the site periodically and determine whether it is necessary to <br />43 take additional measures to address erosion. <br />Page 1 of 15 <br />
