The Cooperative is the owner of that certain real estate Iocated in Ramsey County, <br />Minnesota, described as Parcel l in Exhibit A at#ached hereto and made a part hereof ("Parcel <br />1"). <br />B. United Properties is the owner of that certain real estate located in Ramsey <br />County, Minnesota, described as Parccl2 and Parce[ 3 in Exhibit A�ttached hereto actd hereby <br />made a part hereof ("Pazce12 and Parcel3"). <br />C. Pursuant to that certain Public Tmprovement Corttract by and between United <br />Pzoperties and the City dated as af. February 28, 2Qi 1{the "Poblic Impravement Con[ract"), <br />United Properties is eonstruCiing and installing a number of public improvements on Pazcels 1, 2, <br />and 3, and the streets shown on the plat of Applewood Pointe of Langton Lake, including a <br />roadway and associatec� curbing (the "Street Imgrovemente'�; a public pathway (the "Pathway <br />Improvemeots"); a sanitary sewer, watermain, flydrants, and storm sewer with autlet control <br />structures and flared end sections, including all above- or below-ground pipes, intakes and/or <br />out�ets and other n�echanical eqvipment associated therewith (collectively, the "Utility <br />Improvements"�; ponds (the "Ponds"); infiltration basins (the "Infiltration Basias"}, and the <br />retaining wall and fence (the "Ret�ining WaII and Fence Improvements"�, the lacation of <br />which improvements is shown on those certain plans attached hsreto as Exhibit B aitached hereto <br />and made a part hereof (ths "Xmgrovement PIans'�.
