REQUEST FOR COUNCIL ACTION <br /> Date: 4/08/13 <br /> Item No.: 12.a <br />Department Approval City Manager Approval <br />Item Description: Approve Resolution of Support for Street Improvement District <br />Legislation <br />B <br />ACKGROUND <br />1 <br />A League of Minnesota Cities initiative that would allow cities to create street improvement <br />2 <br />districts has advanced through several committees and remains viable as the Legislature prepares <br />3 <br />to complete it business in the next few weeks. <br />4 <br />In an effort to demonstrate the broad city support that exists for this initiative, the League is <br />5 <br />seeking resolutions of support from city councils. Support from cities is critical to securing key <br />6 <br />votes from legislators who may not be familiar with the street improvement district initiative. <br />7 <br />We have attached a fact sheet (Attachment A) from the League regarding this legislation that <br />8 <br />outlines key background information. <br />9 <br />Staff is supportive of this legislation as a possible funding tool for future use if the city were to <br />10 <br />create a district such as commercial or retail areas or the Twin Lakes area as an improvement <br />11 <br />district for road improvements in lieu of assessments which are challengeable under state statute. <br />12 <br />This is enabling legislation so it is a city’s choice to use the funding tool. <br />13 <br />PO <br />OLICYBJECTIVE <br />14 <br />The city seeks equitable and authorized funding solutions for infrastructure. This legislation <br />15 <br />would give the city another option to fund specific street infrastructure. <br />16 <br />FI <br />INANCIALMPACTS <br />17 <br />There is no financial impact supporting this legislation. This is simply enabling legislation for <br />18 <br />local governments. Local governments can choose whether to create a street improvement <br />19 <br />district for a portion of their city. <br />20 <br />SR <br />TAFF ECOMMENDATION <br />21 <br />Staff recommends the City Council adopt the attached resolution of support for Street <br />22 <br />Improvement District Legislation. This could be an important tool for many cities across the <br />23 <br />state to assist with the funding of their street infrastructure. It does not pose the same risk of <br />24 <br />challenge as Chapter 429 assessments.
