LESSOR and LESSEE are at times <br /> collectively referred to hereinafter as the"Parties" or individually as the "Party". <br /> 1. LESSOR and LESSEE entered into a Tower Lease Agreement (the "Agreement") on <br /> , 20 , for an initial term of five (5) years, commencing on the <br /> Commencement Date. The Agreement shall automatically be extended for four (4) <br /> additional five (5) year terms unless LESSEE terminates it at the end of the then current <br /> term by giving LESSOR written notice of the intent to terminate at least six (6) months <br /> prior to the end of the then current term. The Agreement may be extended for a further <br /> term of five (5) years and for five (5) year terms thereafter upon the mutual agreement of <br /> both Parties in writing. <br /> 2. Pursuant to the Agreement, LESSOR leased to the LESSEE a portion of that certain <br /> space ("the Tower Space") on the LESSOR's water tower, hereinafter referred to as the <br /> "Tower", located at 1901 Alta Vista Drive, City of Roseville, County of Ramsey, State of <br /> Minnesota, as legally described on Exhibit "A" attached hereto and made a part hereof, <br /> together with a parcel of land sufficient for the installation of LESSEE's equipment <br /> building; together with the non-exclusive right for ingress and egress, seven (7) days a <br /> week, twenty-four (24) hours a day, on foot or motor vehicle, including trucks, and for <br /> MINC Rosey <br /> Memorandum of Tower Lease Agreement 1 <br /> 2201286v2 <br />
