Given the existing list of exempt structures and their typical height and diameter <br />59 <br />or width, the Planning Division would conclude that an industrial silo is no <br />60 <br />different than a grain elevator or a large smokestack or even a water tower, except <br />61 <br />that industrial silos are narrower, similar to their agriculture counterparts. <br />62 <br />Although the Community Development Department has the ability to interpret <br />63 <br />whether a use is similar to one listed, there can be instances where such an <br />64 <br />interpretation is not always clear-cut and it would be in the City’s best interest to, <br />65 <br />in this case, include industrial silos to the exempt list and actually provide <br />66 <br />language that affords the Community Development Department the ability to <br />67 <br />determine likeness/similarities that support a structure being structure being <br />68 <br />exempt from height limitations. <br />69 <br />2.0SR <br />TAFF ECOMMENDATION <br />70 <br />The Roseville Planning Division recommends amendments to Section 1011.07 of <br />71 <br />the Zoning Ordinance: <br />72 <br />1011.07 Height Exemptions in All Districts: <br />73 <br />A. The building and structure height limitations established for each zoning <br />74 <br />however, <br />district shall apply to all buildings and structures, except that the <br />75 <br />structures and others that are determined by the Community <br />following <br />76 <br />Development Department to be consistent and/or similar to those listed, <br />77 <br />shall be exempt from said height limitation: <br />78 <br />1.Church spires <br />79 <br />2.Belfries <br />80 <br />3.Cupolas and domes which do not contain usable space <br />81 <br />4.Monuments <br />82 <br />5.Water towers <br />83 <br />6.Fire and hose towers <br />84 <br />7.Observation towers <br />85 <br />8.Flagpoles <br />86 <br />9.Electrical transmission towers <br />87 <br />10.Chimneys <br />88 <br />11.Smokestacks <br />89 <br />12.Parapet walls extending not more than 3 feet above the limiting height <br />90 <br />of the building <br />91 <br />13.Cooling towers <br />92 <br />14.Grain elevators <br />93 <br />15.Elevator penthouses <br />94 <br />16.Industrial silos <br />95 <br />Exception: <br />B.If, in the opinion of the Community Development Department, <br />96 <br />such structure would adversely affect adjacent property, such greater height <br />97 <br />shall not be authorized except by the City Council pursuant to the appeals <br />98 <br />procedure established in Section 1009.08. <br />99 <br />100 <br />Amdt11_RCA_052013.doc <br />Page 3 of 4 <br /> <br />
