~ Extrad of Minutes of Meeting of City Council City of Roseville Ramsey County, Minnesota Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was duly held in the City Hall at 2660 Civic Center Drive, Roseville, Minnesota, on Monday, the 26nd day of April, 1999, at 6:30 p.m.. The following members were present: Wiski, Maschka, Mastel, Goedeke, Wall and the following were absent: None Member Mastel introduced the following resolution and moved its adoption: Resolution No. 9650 A Resolution Amending Resolution 9644 Vacating a Portion of County Road 0 In Connedion with the Proposed Redevelopment at 3116 Fairview Avenue North (Ric Cox: PF3092) WHEREAS, the Planning Commission held a public hearing on the request of Ric Cox for vacation of a portion of County Road D in connection with the proposed redevelopment of the parcel at the southeast corner of Fairview Avenue and County Road D (3116 Fairview Avenue North) to allow for a small office building; and WHEREAS, the Planning Commission recommended approval of the Ric Cox request for vacation of a portion of County Road D, approximately 7 ¥z feet wide by 155.99 feet in length, directly east of Fairview Avenue adjacent to property located at 3116 Fairview Avenue North, based on findings ofthe staff report dated March 10, 1999; and WHEREAS, the approved resolution describing the right-of-way vacation inadvertently excluded a small portion of the right-of-way impacted by a roof over-hang that protrudes angular (west to east) into said right-of-way; and WHEREAS, it is in the public interest to correct the previously approved resolution vacating a portion of County Road D in connection with the request for a Planned Unit Development to redevelop the parcel at the southeast corner of Fairview and County Road D as a small office building (4,000-5,000 s.f.); NOW THEREFORE BE IT RESOLVED that the City Council of the City of Roseville, Minnesota, hereby vacates a portion of County Road D, said area legally described as: The South 7.5 feet of the north 33.0 feet of the following described property: Commencing at the Northeast Quarter of Section 4, Township 29, Range23; thence east 200.00 feet; thence south 133.00 feet; thence west 200.00 feet; thence 133.00 feet to the point of beginning.
