If there are no surviving children, the member’s spouse may waive, in writing, wholly or <br />partially, the spouse’s entitlement to a survivor benefit. <br />A designated beneficiary may be a trust created under Minnesota Statutes, Chapter 501B, <br />if the survivor benefit will be distributed as a lump sum payment. If a trust was created <br />and is payable to the surviving children and there is no surviving spouse, the survivor <br />benefit may be paid to the trust. <br />Section 44A Less Than 20 Years Service <br />Notwithstanding anything to the contrary in these Bylaws, a member who separates from <br />active service and who has been a member of this Association for at least ten (10) years, <br />but less than twenty (20) years, and who has completed not less than ten (10) years of <br />active service as an active firefighter, shall upon attaining the age of fifty (50) years be <br />entitled to receive a lump sum service pension in such amount as is earned to the date of <br />separation from active service for each full year of service completed as follows: <br /> COMPLETED YEARS PRO RATE SERVICE <br /> OF SERVICE PENSION AMOUNT <br /> 10 60% <br /> 11 64% <br /> 12 68% <br /> 13 72% <br /> 14 76% <br /> 15 80% <br /> 16 84% <br /> 17 88% <br /> 18 92% <br /> 19 96% <br /> 20 and thereafter 100% <br />Qualification for receipt of benefits shall be conclusively determined by the Board of <br />Trustees only upon completion of the following by the separating member: <br />1. Execution of a Severance Statement and Acknowledgment of Forfeiture by <br />the member in the form provided by the Association, within thirty (30) days <br />next following separation from active service. <br />2. Within thirty (30) days next fFollowing the attainment of the age of fifty <br />(50) years by a separated member, the separated member shall make <br />application for the lump sum benefit provided herein, on a form provided <br />by the Association and file same with the Association’s Secretary. Said <br />Application may contain the election to receive the lump sum benefits in up <br /> <br />
