REQUEST FOR CITY COUNCIL ACTION <br />6/03/2013 <br /> DATE: <br /> ITEM NO: 14.b <br />Department Approval: Interim City Manager <br />Item Description: Discuss Planning Division Authority and Proposed Zoning <br />Ordinance Text Amendments <br />B <br />ACKGROUND <br />1 <br />At the May 20, 2013, City Council meeting Councilmember McGehee requested <br />2 <br />three zoning text amendments seeking action along with the discussion items <br />3 <br />pertaining to a new zoning district in the Regional Business District and Twin <br />4 <br />Lakes, be removed from the agenda and forwarded to the June 3 meeting. <br />5 <br />Specifically, Councilmember McGehee desired that the City Council have an <br />6 <br />additional policy discussion on the role the City Council plays in land use issues <br />7 <br />and decisions. <br />8 <br />RR–“” <br />OLES AND ESPONSIBILITIES THE PROCESS <br />9 <br />As policymakers, the Council is charged with adopting ordinances and/or <br />10 <br />resolutions to address the needs of the community. To implement these <br />11 <br />regulations, the City Council gives the professional staff the responsibility to <br />12 <br />interpret and enforce these rules through the City Code. <br />13 <br />The professional staff hired by the City performs many duties and responsibilities <br />14 <br />associated with the City Code and policies. However, their main responsibility is <br />15 <br />to enforce the specific rules established by the City Council. No matter which <br />16 <br />department, finance, planning or engineering, all have detailed rules and <br />17 <br />regulations that require employee interpretation, consideration, implementation <br />18 <br />and/or enforcement. <br />19 <br />The Community Development Department’s role in “development” is much <br />20 <br />different than any other Department. Specifically, the Community Development <br />21 <br />Department is bound by numerous State Statutes that dictate or prescribe certain <br />22 <br />processes and criteria that must be followed. Such requirements begin with State <br />23 <br />Statutes 462.351, Municipal Planning and Development; Policy Statement, where <br />24 <br />the Legislature have given deference to municipalities to design and control <br />25 <br />development through comprehensive planning (462.355) and the use of a zoning <br />26 <br />ordinance (462.357).
