The Planning Staff has determined <br />that the property can be put to a reasonable use under the official controls if two <br />VARIANCES to Section §1009.03M are granted. <br />5.9 The nli�ht of the landowner is due to circumstances unique to the nroperty not <br />created bv the landowner: The property in question is unique. The right-of-way for <br />Lexington Avenue has increased in width over the years due to the County's need to <br />expand capacity and design accordingly. Further, existing structures (some pre-existing <br />non-conforming to current Codes) and trees reduce the ability to view a freestanding sign <br />on the premises if the required setback is not reduced. As well, multi-tenant signage has <br />been supported at heights greater than 8 feet as required by § 1009.03M, where such <br />signage is appropriate. The Planning Staff has determined that the plight of the <br />landowner is due to circumstances unique to the property not created by the <br />landowner. <br />5.10 The variance, if granted, will not alter the essential character of the localitv: The <br />Planning Staff has determined that supporting/approving a ground sign 10 feet in <br />height and set back 1 foot form the property line adjacent to Lexington Avenue will <br />not alter the essential character of the locality, nor adversely affect the public <br />health, safety, or general welfare, of the city or adjacent properties. <br />6.0 STAFF RECOMMENDATION: <br />6.1 The City Planner recommends approval of a 2 foot height VARIANCE to Section <br />§1009.03M (Ground Sign) of the Roseville City Code allowing a freestanding <br />ground/monument sign 10 feet in height and a 14 foot setback VARIANCE to Section <br />§1009.03M (Ground Sign) of the Roseville City Code allowing a freestanding <br />ground/monument sign 1 foot from the property line adjacent to Lexington Avenue at <br />Lexington Professional Building, 1790 Lexington Avenue, based on the comments and <br />findings in Section 5 and the following conditions: <br />a. The freestanding monument/ground sign shall be set back a minimum of 1 foot <br />from the property line adjacent to Lexington Avenue. <br />b. The freestanding monument/ground sign shall be a maximum of 10 feet in height. <br />c. The freestanding monument/ground sign shall not exceed 75 sq. ft. of signage <br />area. <br />d. The variance (if granted) shall expire within 6 months of its approval if a sign <br />permit is not issued (Section 1013.03). <br />7.0 SUGGESTED VARIANCE BOARD ACTION: <br />PF07-008_RVBA_020707 - Page 4 of 5 <br />
