a� <br />� <br />REQUEST FOR VARIANCE BOARD ACTION <br />DATE: 2/7/07 <br />ITEM NO: 4a <br />Department Approval: Agenda Section: <br />BL PUBLIC HEARINGS <br />Item Description: Brad Welp seeks VARIANCES to §1004 (Residential Districts) to allow <br />the construction of a new house which would encroach into the required <br />front- and rear-yard setbacks at 1828 Dale Court (PF07-003). <br />1.0 REQUESTED ACTION: <br />1.1 Mr. Welp seeks variances to § 1004 (Residential Districts) of the City Code to allow the <br />construction of a new house on a recently-created vacant lot. The proposed structure <br />would extend to a distance of about 25 feet from the rear (i.e., Dale Street) property line <br />and about 17 feet from the front (i.e., Dale Court) property line. <br />PROJECT REVIEW HISTORY <br />• Application submitted and determined complete: January 5, 2007. <br />• Sixty-day review deadline: March 6, 2007. <br />• Project report recommendation: February 7, 2007. <br />• Anticipated Variance Board action: February 7, 2007. <br />2.0 SUMMARY OF RECOMMENDATION: <br />2.1 The Planning Division recommends approval of a 5-foot rear yard setback VARIANCE <br />and a 14.5-foot front yard setback VARIANCE to § 1004.016 (Residential Setbacks) of <br />the City Code for the vacant lot at Dale Court and Dale Avenue. See Section 5 of this <br />report for further information and Section 6 of this report for detailed recommendation. <br />3.0 SUGGESTED ACTION: <br />3.1 ADOPT VARIANCE BOARD RESOLUTION 52 APPROVING THE REQUESTED <br />VARIANCES to § 1004.016 (Residential Setbacks) of the City Code to allow the <br />proposed residential construction; see Section 7 below for detailed action. <br />4.0 BACKGROUND: <br />4.1 Charles Weleczki owns the vacant parcel at 1828 Dale Court, at the intersection with <br />Dale Street. The property has a Comprehensive Plan designation of Low-Density <br />Residential (LR) and a zoning classification of Single-Family Residence District (R-1). <br />4.2 This vacant lot was subdivided from a larger parcel (now adjacent to the south) in August <br />of 2005. The Planning Commission and City Council supported and approved the <br />triangular lot; during the minor subdivision hearings, both bodies discussed the rationale <br />for supporting the land division without any further variances. <br />PF07-005 RVBA 020707 <br />Page 1 of 5 <br />
