5.2 The CITY agrees to zone the subject parcels to the following: <br />• Planned Unit Development with an underlying zoning of Single Family <br />Residence District (R-1). <br />5.3 The CITY further agrees to create this zone and overlay district subject to the <br />COLLEGE's compliance with the terms and conditions stipulated in Section 9 and 10 of <br />this agreement, all approved plans, and other necessary approvals. <br />5.4 Minor departures from the approved final development plans, which are consistent with <br />this agreement and the underlying zoning for Northwestern Colle�e may be approved by <br />the CITY's Development Review Committee and/or the Community Development <br />Director or designee, as provided in the Roseville City Code (Section 1008). Substantial <br />departures from the approved final development plans will require an amendment to this <br />AGREEMENT in accordance with Sections 1004, 1008, 1010, 1012, 1015, and 1016 of <br />the Roseville City Code. Where not superseded by the requirements of this <br />AGREEMENT, the standards or the underlying R-1 zone shall apply, as stated in Chapter <br />1004 of the Roseville City Code. Whether an issue is "minor" or "signiticant" is the sole <br />responsibility of the CITY and shall be determined by the CITY as defined in Section <br />1008.09 of the City Code. <br />�;�Eixlq������,� <br />G.0 DEVELOPMENT of PROPERTY: <br />6.1 The COLLEGE shall commence and undertake site and structure development activities <br />in accordance with the attached plans and maps as identified in Section 4 of this <br />AGREEMENT and the terms and conditions identified in Section 9 and 10 of this <br />AGREEMENT. Failure to commence an anticipated activity shall not constitute a breach <br />or be deemed a violation of this AGREEMENT. The Northwestern College Planned Unit <br />Development Agreement shall not have a deadline for completion of improvements. <br />6.2 For purposes of this provision, development activity shall be defined as obtaining a <br />building permit, commencing footings and foundations, and continuing with project <br />construction on the site. <br />6.3 Development of the property and installation of public & private improvements shall be <br />in substantial accordance with the anticipated phasing schedule provided by the <br />COLLEGE and approved by the CITY (Exhibit B). <br />7.0 COMPLIANCE with LAWS and REGULATIONS: <br />7.1 The COLLEGE represents to the CITY that, to the best of its knowledge, any site <br />improvements pursuant to the proposed development will comply with all City, County, <br />Watershed, Metropolitan, State, and Federal laws and regulations, including but not <br />limited to the Roseville Subdivision Regulations, the Roseville Zoning Regulations, and <br />all other applicable environmental regulations. <br />
