`.. \..
setback. We wonder if the original owners made the same incorrect assumption that we
did about width of the easement? Given the placement of the house right at 42.5 feet
from the curb, it seems they did!
Second, we did explore a possible alternative to create an entry space in the existing
kitchen at the current doorway by adding on to the back of the house and moving the
kitchen about 8 feet to the north. This would require a much larger foundation area,
engineering design and support for the primary load-bearing wall that supports the roof
and second floor structure, more extensive plumbing and heating modifications, and
rather complex roof design due to existing dormers that would interfere with an
architecturally consistent gable roof. In the end, the cost of this alternative was beyond
our budget and would not add sufficient value to justify the required investment.
Third, family circumstances have resulted in our home becoming a primary gathering
place for our aging parents and our extended families. The capacity of the house to serve
this important function, which we believe qualifies as a"reasonable use" within the
statute language, is definitely restricted by the current functionality and safety of our
existing entry and by the subsequent restricted configuration of kitchen and dining space
that results from having no entry space available. Our only practical alternative at this
point is to move to another house, something we'd rather avoid at this point in our lives!
