� <br />u <br />REQUEST FOR CITY COUNCIL ACTION <br />DATE: 8/25/08 <br />IT'EM NO: 12.d <br />Department Approval: Ciry Manager Approval: <br />i � <br />Item Description: Response to Citizen Petition for an Environmental Assessment Worksheet <br />for the Applewood Pointe Development, 3008-3010Cleveland Ave (PF07- <br />006). <br />1.0 REQUESTED ACTION <br />1.1 On August 14, 2008, the Roseville Community Development Department received the <br />Citizen's Petition for an EAW for the Applewood Pointe development located at 3008 <br />and 3010 Cleveland Ave. from the Environmental Quality Board (EQB). In the cover <br />letter the EQB states that the City of Roseville is the appropriate governmental unit <br />(RGU) to determine the need for an EAW. <br />1.2 Minnesota Rules, chapter 4410 require the RGU to decide on the preparation of an EAW, <br />which requires the City to compare the project to the mandatory EAW, EIS and <br />Exemption categories listed in parts 4410.4300, 4410.4400, and 4410.4600 respectively. <br />2.0 SUMMARY OF RECOMMENDATION <br />2.1 The Community Development Department and City Attorney have reviewed the citizen <br />petition seeking an EAW and find that the project is exempt from environmental review <br />as outlined in Minnesota Rules 4410.4600 (2) (E). <br />2.2 The reason for the exemption is that the subject property is within the study area for the <br />Twin Lakes Business Park Final AUAR Update (both in the original AUAR completed in <br />2001 and the update completed in 2007) and thus has already been subjected to <br />environmental review. <br />3.0 SUGGESTED ACTION <br />3.1 Adopt a RESOLUTtON DENYING the CITIZEN PETITION for an EAW. <br />RCA_082508.doc Page 1 of 3 <br />
