Parcels outlined in red fail to comply with all <br />pCode requirements pertaining to lot size or area; <br />red hatching indicates that related variances were <br />(or were not) approved. <br />Nonconforming parcels created before 1959 and <br />because they predate the current lot size and <br />area requirements, they are legally nonconforming. <br />All of the nonconforming parcels created in the <br />1970's and 1980's were processed as minor sub- <br />divisions, with no consideration of the variances <br />required to account for their nonconformities. The <br />current application was approved under these <br />circumstances in 1986, but the property owner <br />never recorded the new legal descriptions. <br />In 1997, one property owner applied for a minor <br />subdivision and the necessary variances for the <br />substandard lot sizes. This request was denied <br />because the applicant failed to produce some of <br />the information that was required for apt review. <br />While more than half of the parcels in this area <br />are smaller in some way than the Code requires, <br />only three of them have received the necessary <br />variances to resolve the nonconforming conditions. <br />
