1013.02B Variances — Procedure for Variances <br />Any owner of land may file an application for a variance by paying the fee set <br />forth in section 1014.03 of this title, providing a completed application and <br />supporting documents as set forth in the standard community development <br />department application form, and by providing the city with an abstractor's <br />certified property certificate showing the property owners within 500 feet of the <br />outer boundaries of the parcel of land on which the variance is requested. The <br />application shall then be heard by the variance board or planning commission <br />upon the same published notice, mailing notice and hearing procedure as set forth <br />in chapter 108 of this code. (Ord. 1176, 11-25-1996) (Ord. 1301, passed 2-9-2004, <br />effective 4-1-2004) <br />1013.04 Procedure for Vacating Street or Alley <br />Any application to vacate a street or alley shall be accompanied by payment of the <br />amount set forth in section 1014.03 of this title and by an abstractor's certified <br />property certificate showing the property owners within 500 feet of the street or <br />alley desired to be vacated. The application shall be heard by the planning <br />commission procedure set forth in chapter 108 of this code, except that the notice <br />shall contain a description of the location of the street or alley to be vacated. (Ord. <br />1176, 11-25-1996) <br />1014.04B1 Board of Zoning Adjustment and Appeals — Zoning Variances <br />The Community Development Director or designee shall provide written notice of <br />the request, as per Section 108 of this Code to all property owners within 500 feet <br />prior to a hearing of the Variance Board and shall publish notice of public hearing <br />in the official newspaper at least ten (10) days prior to said hearing. <br />1014.04C2 Board of Zoning Adjustment and Appeals — Appeals <br />The written appeal shall state the specific grounds upon which the appeal is made <br />and shall be accompanied by a fee established by resolution of the City Council. <br />A public meeting regarding the matter shall be held before the Board of <br />Adjustment and Appeal at a regular meeting held within 30 days of the receipt of <br />the required written appeal. A mailed notice of the public meeting at which the <br />appeal is to be considered shall be sent to members of the Variance Board (if <br />applicable) and to all of those property owners within 500 feet of the subject <br />property as well as the owner and tenants (if any) of the subject property.
