If this request is approved, <br />Planning Division staff would recommend adding a condition that would require the <br />applicant to submit a new survey for staff review to ensure that it is consistent with the <br />approval. <br />6.0 STAFF RECOMMENDATION <br />6.1 Based on the comments and findings outlined in Sections 4 and 5 of this report, the <br />Planning Division cannot make a recommendation far the proposed MINOR <br />SUBDIVISION AND VARIANCES which would allow the creation of two new <br />substandard parcels from the existing property at 1754 Alta Vista Drive. Below are some <br />findings of fact that the Planning Commission may consider in the formulation of a <br />recommendation to the City Council: <br />a. Findings of Fact: denial: <br />The proposed parcels fail to meet the minimum standards established in <br />the City Code and the applicant has not sufficiently demonstrated that the <br />requested variances would relieve an undue hardship caused by the strict <br />application of the Code requirements. <br />b. Findings of Fact: approval <br />1. Other parcels of similar or smaller size have existed in the immediate <br />vicinity since the area was platted in 1876. <br />2. Other parcels of similar or smaller size have been created with and <br />without the necessary variances since 1983. <br />3. This minor subdivision was approved in 1986, since which time the <br />minimum lot size and area requirements have not changed. <br />6.2 If the Planning Commission finds that it is appropriate to approve the requested MINOR <br />SUBDIVISION AND VARIANCES, Planning Division staff recommends attaching the <br />following conditions: <br />a. Private utility easements must be dedicated to ensure that both parcels have the <br />necessary access to sewer and water. Payment of the $1,500 Metro Area Sewer <br />Availability Charge must be made as required upon the issuance of a building <br />permit for new construction on Parcel A; <br />b. Drainage easements consistent with Code requirements must be dedicated on <br />Parcel A; <br />c. Within thirty (30) days after approval by the City Council, the applicant shall <br />supply the final survey to the Community Development Director for review and <br />approval to ensure that the subdivision is consistent with the intent of the <br />approval. The final survey must show the required easements and resolve the <br />outstanding question of the size of the existing property (any additional, verified <br />land area may be allocated to one or both of the proposed new parcels at the <br />properiy owner's discretion); and <br />d. A certificate of survey shall be required on all proposed parcels. After completion <br />of the review and approval by the City Manager, the survey shall be recarded by <br />the applicant with the Ramsey County Recorder within sixty (60) days.
