Specifically, you inquired <br />about the procedures for public notice, citizen review, agency review and responses to <br />comments. Your request makes reference to the document "Request for CounciI Action," <br />dated October 8, 2007, available at the City's website. I have used that document as the <br />source of my information about the City's procedures presuming that it is an accurate <br />description of the actions taken by the City in the processing of the AUAR update. <br />The EQB's rules specify the procedures for preparing, noticing, reviewing, and adopting <br />an AUAR update at part 4410.3610, subpart 7, which references subpart 5, items D to H. <br />Comparing the itemization of procedures used by the City for the AUAR update listed in <br />the "Request for Comments" document with those provisions of the rules, it appears that <br />the steps required by the EQB's rules begin at item #2.15. After examining the actions <br />beginning with #2.15, I conclude that the actions listed comply with the requirements of <br />the EQB's rules for preparing and reviewing an AUAR update, including the <br />requirements for citizen review. I would like to clarify that you neither asked for EQB's <br />opinion about the substance of the AUAR update, nor is the EQB staff offering any <br />opinions about the substance of the AUAR or the City's decisions, including the <br />responses ta comments. Our opinion expressed here is limited solely to compliance with <br />procedural requirements. <br />I hope this response meets your needs.
