-e <br />---, <br />Exhibit J Monument sign design and detail plan dated June 22, 1999. <br />Exhibit K Floor plan indicating proposed interior structure layout, dated June 21, 1999 <br />Exhibit L Building elevation plan indication structure height, facade details and building <br />materials dated June I5, 1999. <br />Exhibit M Proposed development schedule with installation dates of improvements, <br />including anticipated beginning date, grading, footings, building construction, <br />paving, landscaping, and anticipated occupancy date, dated June 22, 1999. <br />5.0 Rezoning <br />The CITY conducted hearings and meetings on March 10 & April, 1999 (Planning Commission - <br />hearing on concept development plan), Apri126, & May 10,1999 (City Council — action on concept), <br />June 23 & July 12, 1999 (City Council — hearing and action on final development plan and action on <br />PUD agreement) to consider various aspects of the Planned Unit Development, including rezoning of <br />the subject property from B-1, Limited Business District to Business-Planned Unit Development (B- <br />PUD). The CITY agrees to rezone the subject property to Business-Planned Unit Development (B- <br />PUD), subject to the DEVELOPER'S strict compliance with the approved plans, and the terms and <br />conditions of this agreement. Minor variations from the approved final development plans, which are <br />consistent with this agreement and the underlying B-1 zoning district, may be approved by the <br />CITY's Development Review Committee, under the direction of the Community Development <br />Director. Substantial departures from the approved final development plans will require an <br />amendment to the Planned Unit Development in accordance with Section 1015 of the Roseville <br />Zoning Ordinance. Where not superseded by more restrictive requirements of this PUD, the <br />standards of the underlying B-1 (Limited Business) zoning district shall apply, as stated in Chapter <br />1005 of the Roseville City Code. <br />6.0 Development of Property <br />Failure by the DEVELOPER to commence development activity in accordance with the final <br />development plans or within one year following the final approval of this Planned Unit <br />Development, will necessitate the approval of an extension of the development schedule by the City <br />Council prior to the expiration of the one year period. If an extension is not applied for, the Council <br />may instruct the Planning Commission to initiate rezoning to the original B-1 zoning district. For <br />purposes of this provision, development activity shall be defined as obtaining a building permit and <br />beginning construction on the site. <br />Development of the property and installation of improvements shall be in accordance with the <br />development schedule provided by the DEVELOPER and approved by the CITY (Exhibit F). <br />7.0 Compliance with Laws and Regulations <br />The DEVELOPER represents to the CITY that any site improvements pursuant to the proposed <br />Development will comply with all City, County, Regional, Metropolitan, State, and Federal laws and <br />regulations, including but not limited to the Roseville Subdivision Regulations, the Roseville Zoning <br />Page 3 of 10 <br />
