` <br />--. <br />REQUEST FOR PLANNING COMMISSION ACTION <br />Department Approval: <br />DATE: 9/OS/06 <br />ITEM NO: 6a <br />Agenda Section: <br />PUBLIC HEARINGS <br />Item Description: Eugene Schultz, owner of the property at 1940 Lexington Avenue, seeks a <br />PLANNED iJNIT DEVELOPMENT AMENDMENT in conjunction <br />with Melissa Olson, owner of The Bookshop, to allow a used book store <br />as a permitted use in the existing multi-tenant building (PF07-O50). <br />1.0 REQUESTED ACTION: <br />1.1 Melissa Olson is requesting the Planned Unit Development Amendment in order to <br />relocate her new/used book store, The Bookshop, from the Har Mar Mall to the 3,000- <br />square-foot retail space in the building at 1940 Lexington Avenue. <br />PROJECT REVIEW HISTORY <br />• Application submitted: August 1, 2007; Determined complete: August 8, 2007 <br />� Sixty-day review deadline: September 28, 2007 <br />• Project report recommendation: September 5, 2007 <br />• Anticipated Planning Commission action: September 5, 2007 <br />• Anticipated City Council action: September 24, 2007 <br />2.0 SUMMARY OF STAFF RECOMMENDATION: <br />2.1 The Planning Division recommends approval of the requested PLANNED LTNIT <br />DEVELOPMENT AMENDMENT, subject to certain conditions; see Section 7 of this <br />report for the detailed recommendation. <br />3.0 SUMMARY OF SUGGESTED ACTION: <br />3.1 By motion, recommend approval ofthe requested PLANNED UNIT DEVELOPMENT <br />AMENDMENT, pursuant to § 1013.01 (Conditional Use Permits) of the City Code, <br />subject to conditions; see Section 8 of this report far the detailed action. <br />4.0 BACKGROUND: <br />4.1 The existing Planned Unit Development (PUD) was approved in 1999 and allows <br />office/laboratory uses and retail sales of antiques, handicrafts, and gifts in addition to <br />most of the other uses permitted or conditionally permitted in the underlying Limited <br />Business (B-1) Zoning District. <br />4.2 This PUD Amendment request has been prompted by the applicants' desire to include a <br />bookstore among the permitted uses. <br />PF07-O50 RPCA 090507 <br />Page 1 of 4 <br />
