-�. <br />9 July Zoo9 <br />Eugene Shultz <br />President, G&K Properties <br />7195 137`h Street North <br />Hugo, Minnesota 55038 <br />� <br />1�� <br />.�.,►.-- � . _ � i i <br />RE: PUD Agreement for Lexington Professional Building, 1940-1944 Lexington Avenue <br />Dear Mr. Shultz, <br />After you came to City Hall on February 5'h of this year to sign and notarize the PUD Agreement <br />for the above property, I sent it to Ramsey County to be recorded, but the Ramsey County <br />Recorder's office returned the document to me and informed me that they cannot record it until <br />delinquent property taxes have been paid. I have included for your reference a printout of the tax <br />payment information currently on Ramsey County's website. <br />In reviewing the enclosed first section of the PUD Agreement, it stipulates that the PUD <br />Agreement is not officially valid until the document has been recorded with Ramsey County. <br />Although The Bookshop, which is allowed through the PUD Agreement, has been operating at <br />the property since the PUD was amended in 2007, failure to pay the delinquent property taxes <br />consequently prevents the recording of the documentation and would seem to imperil the land <br />use approvals that the PUD Agreement confers to your property. <br />Please pay the delinquent taxes (or make payrnent arrangements with Ramsey County) by <br />September 1, 2009 such that Ramsey County will accept and record the documents. If you <br />believe that the property tax payments are up to date and that the indication of delinquency is an <br />error, please contact the County's tax office to correct this error.
